1 RESOLUTION NO. 87 -62
2 A RESOLUTION APPROVING THE MERGER OF WATER DISTRICT 6 AND BIRCH BAY
3 WATER DISTRICT 8 AND CHANGING THE NAME OF THE COMBINED DISTRICT TO
BIRCH BAY WATER AND SEWER DISTRICT.

5 WHEREAS, Water District 6 and Water District 8 desire to merge and change
the name of the combined district to Birch Bay Water and Sewer District and have
6 obtained all necessary agreements by their constituents to the merger and the
7 change of name; and

WHEREAS, RCW 57.02.040 requires the County Council to approve any merger of
9 Water Districts and to consider whether a
proposed merger is in accordance with
10 the Comprehensive Plan, any state basinwide plans, and the county policies
11 regarding water and /or sewerage facilities; and
12 WHEREAS, the proposed merger is in agreement with the Birch Bay - Blaine
13 Comprehensive Plan and was recommended as providing better service to the
14 citizens of the area; and
15 WHEREAS, there are no state basinwide plans in effect at this time for the
16 area within the district's boundaries; and

WHEREAS, the county policies for water and sewer service are in favor of
18 minimizing the number of purveyers; and
19
WHEREAS, the new name reflects the location and range of services and is a
20
logical choice for the combined district;

22 NOW, THEREFORE, BE -IT R$SOLVED by the Whatcom County Council as follows:

SECTION 1: The Council approves the merger of Water District 6 and Birch Bay
24 Water District 8.

SECTION 2: The Council approves the change of name from Birch Bay Water
26 District 8 to Birch Bay Water and Sewer District.
