Board DATE INTRODUCED: November 5, 1987 RESOLUTION NO. 87 -53 A RESOLUTION IN THE MATTER OF APPLICATION TO THE SEC- RETARY OF THE INTERIOR FOR AND SECURING TRANSFER OF REAL PROPERTY OWNED BY THE UNITED STATES; MORE COM- MONLY KNOWN AS BLAINE AIR FORCE STATION, TO WHATCOM COUNTY AND GIVING THE PARK DIRECTOR THE AUTHORITY TO PERFORM ALL DUTIES IN THE ACQUISITION AND MAINTENANCE OF SAID PROPERTY WHEREAS, certain real property owned by the United States located in the County of Whatcom, State of Washington, has been declared surplus and at the discretion of the General Services Administration, may be assigned to the Secretary of the Inte- rior for disposal for public park or recreation purposes, under the provisions of Section 203 (k) (2) of the Federal Property and Administrative Services Act of 1979 (63 Stat. 387), as amended, and rules and regulations promulgated pursuant thereto, more particularly described as follows: Property Description: That portion of the Southwest Quarter of the Northeast Quarter of Section 31, Township 48 North, Range 1 East, W.M., described as follows: Beginning at the Northeast 1/16 corner of said Section 31; thence South 01° 47' 44" West along the East line of said Southwest Quarter, Northeast Quarter 30.00 feet to the South edge of Alderson Road and the True Point of Beginning; thence continuing along said East line South 0r' 47' 44" West 713.36 feet; thence North 87° 54' 33" West, parallel to the North line of said Southwest Quarter, Northeast Quarter 785.80 feet; thence North Of 48' 32" East parallel to the West line of said Southwest Quarter, Northeast Quarter 713.36 feet to the South edge of Alderson Road; thence South 870 54' 33" East 785.64 feet along said South edge to the True Point of Beginning. Situate in Whatcom County, Washington. Easement Location: A 20 foot wide easement for the construction and maintenance of a natural gas pipeline in Section 31, Township 40 North, Range 1 East of W.M., Whatcom County, Washington, said easement being 10.00 feet on each side of the following described centerline: Commencing at the Northeast corner of the Southwest quarter of the Northeast Quarter of said Section 31, as shown on that cer- tain map filed in Book 1 of Surveys, on Page 13, under Auditor's File No. 1407268, records of said County and State; thence South 01" 47' 44" West along the East line of the South- west Quarter of the Northeast quarter of Section 31, for a dis- tance of 30.00 feet to the South line of the Alderson Road; thence North 87` 54' 33" West, along said South line of the 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 Alderson Road; thence North 871 54' 33" West, along said South line, for a distance of 26.18 feet to the True Point of Begin- ning of said described centerline; thence South 00° 47' 44" West, parallel with the East line of said Southwest Quarter of the Northeast Quarter, for a distance of 713.35 feet to the end of said centerline, said point being on the North line of Lot 8, "Titan Terrace Subdivision ", as per the map thereof, re- corded in Volume 15 of Plats, on Page 36, in the Auditor's of- fice of said County and State; said point lying North 870 54' 28" West a distance of 26.18 feet from the Northeast corner of said Lot 8. GSA Control No. 9- GR(1)- WA -749B Total Acreage of Property: Approximately 12.87 Acreage Being Requested: Approximately 12.87 and; WHEREAS, Whatcom County needs and will utilize said prop- erty in perpetuity for a public park or recreation area as set forth in its application and in accordance with the require- ments of said Act and the rules and regulations promulgated thereunder; NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: Section l: Whatcom County shall make application to the Secretary of the Interior for, and secure transfer to it, of the above men- tioned property for said use upon and subject to such excep- tions, reservations, terms, covenants, agreements, conditions and restrictions as the Secretary of the Interior, or his au- thorized representative may require in connection with the dis- posal of said property under said Act and the rules and regula- tions issued pursuant thereto. Section 2: Whatcom County has legal authority, is willing and is in a position to assume immediate care and maintenance of the prop- erty and that Roger A. DeSpain, Director, Whatcom County Park and Recreation Board be, and he is hereby authorized, for and on behalf of the County of Whatcom, to do and perform any and all acts and things which may be necessary to carry out the foregoing resolution including the preparing, making and filing 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16' 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 of plans, applications, reports and other documents, the execu- tion, acceptance, delivery and recordation of agreements, deeds and other instruments pertaining to the transfer of said prop- erty, including the filing of copies of the application and the conveyance documents in the records of the governing body, and the payment of any and all sums necessary on account of the purchase price thereof or fees or costs incurred in connection with the transfer of said property for survey, title, searches, recordation or instruments, or other costs identified with the Federal surplus property acquisition, provided, however, that all final applications or contracts shall be subject to the ap- proval of the Whatcom County Council.
