A Resolution of Intent in the matter of Formation of
2 Whatcom County road Improvement District No. 7
(Emerald Lake Lighting District)

Be it resolved by the Whatcom County Council:
4 SECTION 1:

The Whatcom County Council has been presented with, and has accepted a
6
request to initiate formation of a County Road Improvement District for Emerald
7
Lake, The Lighting District, located in portions of Sections 10, 11, and 14,
8
Township 38 North, Range 3 East of W.M. Whatcom County, Washington.

SECTION 2:

The nature and territorial extent of the improvements shall be as
11
follows:

1. To install and maintain approximately 13 street lights within

The Emerald Lake Lighting District.

SECTION 3:

The legal description of the boundary of the proposed Road Improvemeni
16
District is attached hereto as Exhibit "A ".

SECTION 4:

The total estimated costs of the improvement is: $3,000.00 the first
19
year, with reduced annual maintenance costs thereafter.

SECTION 5:

The entire cost and expense of the Road Improvement District will be
22
borne by the property within the proposed district. The first annual main -
23
tenance assessment shall be based upon a Whatcom County Department of Public
24
Works fee of $0.50 per lot per year and a per parcel charge of $7.00 per lot.

The second and each succeeding annual maintenance assessment shall be
26
based upon a Whatcom County Department of Public Works fee of $0.50 per lot
27
per year plus the actual cost of maintenance and power charges not to exceed
28
$7.00 per lot per year. Prior to the second and each succeeding annual main -
29
tenance assessment, a budget for Whatcom County Road Improvement District No. 7
30
shall•be submitted to the Whatcom County Executive for approval.

All property within the proposed road improvement district shall
contribute towards the improvement of Emerald Lake Lighting District on a per
parcel basis.
SECTION 6:
Those parcels of land which have been divided and have created a
separate parcel after the dedication of the Plat of Emerald Lake, Division No. 1
filed in Book 8, page 95 of records shall be assessed as separate lots.
SECTION 7:
The owners of property in said proposed R.I.D. No.7 shall be notified
to appear at a meeting of Whatcom County Council in the Council hearing room on
the second floor of the Whatcom County Courthouse to be held at 7:30 p.m., or as
soon thereafter as possible, on the 5th day of November , 1987, on the
proposed R.I.D. No.7.
SECTION 8:
The County Engineer is directed to submit to the Council at or prior
to the meeting specified in the preceeding section, a diagram or print showing
thereon the lots, tracts, and parcels of land and property which will be spe-
cially benefited, and the estimated amount of the cost and expanse to be borne
by each lot, tract, or parcel therein, and also designating thereon all property
which is being purchased under contract from the County.
SECTION 9:
This Resolution of Intention shall be published in at least two (2)
consecutive issues of a newspaper of general circulation in the County, with the
date of the first publication to be at least fifteen (15) days prior to the date
fixed by this resolution for hearing before the Whatcom County Council.
SECTION 10:
The County Engineer shall see that notices of adoption of this
Resolution of Intention is given to each owner or reputed owner of a lot, tract,
or parcel of land within the proposed district by mailing to the owner or
reputed owner of the property as shown on the tax rolls of the County Treasurer
at the address shown thereon at least fifteen (15) days before the date fixed
for the public hearing. The notice shall refer to this resolution and the
designated number of the improvement district, and shall set forth the nature of

the proposed improvement, the total estimated amount of the cost and expense of
such improvement to be borne by the particular lot, tract or parcel, the date
and place of the hearing before the Whatcom County Council, and shall contain
the directions for voting upon the formation of the proposed district.
SECTION 11:
The Clerk.of the Council shall prepare and mail, together with the
notice above referred to, a ballot for each owner or reputed owner of any lot,
tract, or parcel of land within the proposed improvement district. The ballot
shall contain the following proposition:

"Shall Whatcom County Road Improvement District No. 7 be formed ?"

and, in addition, shall contain appropriate spaces for the signatures of the
property owners, and a description of their property, and shall have typed or
printed thereon the direction that all ballots must be signed to be valid and

must be returned to the Clerk of the Council not later than five (5:00) o'clock
p.m. of a day which shall be one (1) week after the date of the public hearing.
SECTION 12:
This notice of adoption of the Resolution of Intention shall also con-
tain the above directions, and in addition, thereto, shall state the rules by
which the election shall be governed.
