HomeMy WebLinkAboutres1987-0481 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 SELLERS.1087 INTRODUCED BY: WARNER PROPOSED BY: County Executive DATE: OCTOBER 15, 1987 RESOLUTION NO. 87 -48 A RESOLUTION TO SELL PROPERTY ACQUIRED BY COUNTY ON TAX FORECLOSURE WHEREAS, RCW 84.64.270 allows the County to sell real estat acquired by tax foreclosures where it is found to be in the best interests of Whatcom County to sell the same; and, WHEREAS, Whatcom County Council does deem it to be in the County's best interest subsequent to a public hearing, to sell some lots in Sudden Valley Subdivision which have been received through tax foreclosure, specifically: Division 22, Lot 340; Division 1, Lot 12; Division 16, Lot 62; Division 4, Lot 51; and, Tax #2.5, Section 26, Township 38, Range 1E, which has al: been received through tax foreclosure; and, WHEREAS, the Whatcom County Code as well as the state law allows the County to reserve from-the sale, coal, oil, gas, gravel, minerals, ores, fossils, timber or other resources if the Council finds that it is in the best interest to reserve these; and, WHEREAS, RCW 84.64 requires the Council to establish the minimum.price for said unit of property and to determine whether or not a contract will be allowed or if it will be a cash price; and, NOW, THEREFORE, BE IT RESOLVED that it is in the best inter est of the County to sell Division 22, Lot 340 in Sudden Valley of the County to sell Division 22, Lot 340 in Sudden Valley Subdivision for the minimum price of $902.68 plus costs and further in this sale transferring to the owner all coal, oil, gas gravel, minerals, ores, fossils, timber or other resources on or RESOLUTION - 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 in said lands and the right to mine for and remove the same in conformity with zoning regulations in force and effect; and, BE IT FURTHER RESOLVED that it is in the best interest of the County to sell Division 1, Lot 12 in Sudden Valley Subdivi- sion for the minimum price of $877.47 plus costs and further in this sale transferring to the owner all coal, oil, gas, gravel, minerals, ores, fossils, timber or other resources on or in said lands and the right to mine for and remove the same in conformity with zoning regulations in force and effect; and, BE IT FURTHER RESOLVED that it is in the best interest of the County to sell Division 16, Lot 62 in Sudden Valley Subdivi sion for the minimum price of $760.72 plus costs and further in this sale transferring to the owner all coal, oil, gas, gravel, minerals, ores, fossils, timber or other resources on or in said lands and the right to mine for and remove the same in conformity with zoning regulations in force and effect; and, BE IT FURTHER RESOLVED that it is in the best interest of the County to sell Division 4, Lot 51 in Sudden Valley Subdivi- sion for the minimum price of $901.55 plus costs and further in this sale transferring to the owner all coal, oil, gas, gravel, minerals, ores, fossils, timber or other resources on or in said lands and the right to mine for and remove the same in conformity with zoning regulations in force and effect; and, BE IT FURTHER RESOLVED that it is in the best interest of the County to sell Tax #2.5 , Section 26, Township 38, Range 1 for a minimum price of $2,757.71 plus costs and further in thi sale reserving all mineral rights; and, BE IT FURTHER RESOLVED that this sale shall be subject to the certification of the County Treasurer. Once the Treasurer shall certify that the price set in this Resolution is the actual amount of taxes which are owed to the County as provided for in RESOLUTION - 2 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 RCW 86.64.270, he shall direct the sale to take place; BE IT FURTHER RESOLVED that said price shall not be allowec under contract and shall be paid in either cash, certified check, or money order to the Whatcom County Treasurer at the time of sale; BE IT FURTHER RESOLVED that the Whatcom County Treasurer is hereby directed to sell such property at not less than a certi- fied price and said sale shall take place in accordance with the duties as established in RCW 84.64.270.
