RESOLUTION NO. 87 -24
A RESOLUTION TO SELL PROPERTY
ACQUIRED BY COUNTY ON TAX
FORECLOSURE
WHEREAS, RCW 84.64.270 allows.the County to sell real estate
acquired by tax foreclosures where it is found to be in the best
interests of Whatcom County to sell the same; and,
WHEREAS, Whatcom County Council does deem it to be in the
County's best interest subsequent to a public hearing, to sell
some lots in Sudden Valley Subdivision which have been received
through tax foreclosure, specifically: Division 11, Lot 115;
Division 5, Lot 36; Division 5, Lot 75; Division 7, Lot 46;
Division 7, Lot 54; Division 16 Lot 213; Division 23, Lot 52;
Division 9, Lot 149; Division 14, Lot 112; Division 28, Lot 15;
and, Lot 35 at Neptune Heights and Lot 12 -ptn 13 at Emerald Lake
which have also been received through tax foreclosure; and,
WHEREAS, the Whatcom County Code as well as the state law
allows the County to reserve from the sale, coal, oil, gas,
gravel, minerals, ores, fossils, timber or other resources if the
Council finds that it is in the best interest to reserve these;
and,
WHEREAS, the Whatcom County Council does deem it in the best
interest of the County not to reserve these mineral rights, but
rather to transfer them with the sale; and,
WHEREAS, RCW 84.64 requires the Council to establish the
minimum price for said unit of property and to determine whether
or not a contract will be allowed or if it will be a cash price;
and,

NON, THEREFORE, BE IT RESOLVED that it is in the best inter-
est of the County to sell Division 11, Lot 15 in Sudden Valley
Subdivision for the minimum price of $933.94 plus costs and
further in this sale transferring to the owner all coal, oil, gas,
gravel, minerals, ores, fossils, timber or other resources on or
in said lands and the right to mine for and remove the same in
conformity with zoning regulations in force and effect; and,
BE IT FURTHER RESOLVED that it is in the best interest of
the County to sell Division 5, Lot 36 in Sudden Valley Subdivi-
sion for the minimum price of $781.06 plus costs and further in
this sale transferring to the owner all coal, oil, gas, gravel,
minerals, ores, fossils, timber or other resources on or in said
lands and the right to mine for and remove the same in conformity
with zoning regulations in force and effect; and,
BE IT FURTHER RESOLVED that it is in the best interest of
the County to sell Division 5, Lot 75 in Sudden Valley Subdivi
sion for the minimum price of $796.06 plus costs and further in
this sale transferring to the owner all coal, oil, gas, gravel,
minerals, ores, fossils, timber or other resources on or in said
lands and the right to mine for and remove the same in conformity
with zoning regulations in force and effect; and,
BE IT FURTHER RESOLVED that it is in the best interest of
the County to sell Division 7, Lot 46 in Sudden Valley Subdivi-
sion for the minimum price of $1,154.51 plus costs and further in
this sale transferring to the owner all coal, oil, gas, gravel,
minerals, ores, fossils, timber or other resources on or in said
lands and the right to mine for and remove.the same in conformity
with zoning regulations in force and effect; and,
BE IT FURTHER RESOLVED that it is in the best interest of
the County to sell Division 7, Lot 54 in Sudden Valley Subdivi-
sion for the minimum price of $1,151.17 plus costs and further in

this sale transferring to the owner all coal, oil, gas, gravel,
minerals, ores, fossils, timber or other resources on or in said
lands and the right to mine for and remove the same in conformity
with zoning regulations in force and effect; and,
BE IT FURTHER ABSOLVED that it is in the best interest of
the County to sell Division 16, Lot 213 in Sudden Valley Subdivi-
sion for the minimum price of $1,113.27 plus costs and further in
this sale transferring to the owner all coal, oil, gas, gravel,
minerals, ores, fossils, timber or other resources on or in said
lands and the right to mine for and remove the same in conformity
with zoning regulations in force and effect; and,
BE IT FURTHER RESOLVED that it is in the best interest of
the County to sell Division 23, Lot 52 in Sudden Valley Subdivi-
sion for the minimum price of $621.96 plus costs and further in
this sale transferring to the owner all coal, oil, gas, gravel,
minerals, ores, fossils, timber or other resources on or in said
lands and the right to mine for and remove the same in conformity
with zoning regulations in force and effect; and,
BE IT FURTHER RESOLVED that it is in the best interest of
the County to sell Division 9, Lot 149 in Sudden Valley Subdivi-
sion for the minimum price of $917.15 plus costs and further in
this sale transferring to the owner all coal, oil, gas, gravel,
minerals, ores, fossils, timber or other resources on or in said
lands and the right to mine for and remove the same in conformity
with zoning regulations in force and effect; and,
BE IT FURTHER ABSOLVED that it is in the best interest of
the County to sell Division 14, Lot 112 in Sudden Valley Subdivi-
sion for the minimum price of $917.14 plus costs and further in
this sale transferring to the owner all coal, oil, gas, gravel,
minerals, ores, fossils, timber or other resources on or in said
lands and the right to mine for and remove the same in conformity
with zoning regulations in force and effect.; and,

BE IT FURTHER RESOLVED that it is in the best interest of
the County to sell Division 28, Lot 15 in Sudden Valley Subdivi-
sion for the minimum price of $1,061.77 plus costs and further in
this sale transferring to the owner all coal, oil, gas, gravel,
minerals, ores, fossils, timber or other resources on or in said
lands and the right to mine for and remove the same in conformity
with zoning regulations in force and effect; and,
BE IT FURTHER RESOLVED that it is in the best interest of
the County to sell Lot 35 in Neptune Heights for the minimum price
of $607.16 plus costs and further in this sale transferring to the
owner all coal, oil, gas, gravel, minerals, ores, fossils, timber

or other resources on or in said lands and the right to mine for
and remove the same in conformity with zoning regulations in force
and effect;.and,
BE IT FURTHER RESOLVED that it is in the best interest of
the County to sell Lot 12 -ptn 13 in Emerald Lake for the minimum
price of $681.35 plus costs and further in this sale transferring
to the owner all coal, oil, gas, gravel, minerals, ores, fossils,
timber or other resources on or in said lands and the right to
mine for and remove the same in conformity with zoning regulations
in force and effect; and,
BE IT FURTHER RESOLVED that this sale shall be subject to
the certification of the County Treasurer. Once the Treasurer
shall certify that the price set in this Resolution is the actual
amount of taxes which are owed to the County as provided for in
RCW 86.64.270, he shall direct the sale to take place;
BE IT FURTHER RESOLVED that said price shall not be allowed
under contract and shall be paid in either cash, certified check,
or money order to the Whatcom County Treasurer at the time of
sale;
BE IT FURTHER RESOLVED that the Whatcom County Treasurer is
hereby directed to sell such property at not less than a certi-

fied price and said sale shall take place in accordance With the
duties as established in RCW 84.64.270.
