RESOLUTION NO. 87 -13
A RESOLUTION TO SELL PROPERTY
ACQUIRED BY COUNTY ON TAX
FORECLOSURE
WHEREAS, RCW 84.64.270 allows the County to sell real estate
acquired by tax foreclosures where it is found to be in the best
interests of Whatcom County to sell the same; and,
WHEREAS, Whatcom County Council does deem it to be in the
County's best interest to sell some lots in Sudden Valley Sub-
division which have been received through tax foreclosure,
specifically; Lot 115, Division 11; Lot 36, Division 5; Lot 75,
Division 5; Lot 46, Division 7; Lot 54, Division 7; and,
WHEREAS, the Whatcom County Code as well as the state law
allows the County to reserve from the sale, coal, oil, gas,
gravel, minerals, ores, fossils, timber or other resources if the
Council finds that it is in the best interest to reserve these;
and,
WHEREAS, the Whatcom County Council does deem it in the best
interest of the County not to reserve these mineral rights, but
rather to transfer them with the sale; and,
WHEREAS, RCW 84.64 requires the Council to establish the
minimum price for said unit of property and to determine whether
or not a contract will be allowed or if it will be a cash price;
and,
NOW, THEREFORE, BE IT RESOLVED that it is in the best
interest of the County to sell Lot 115, Division 11 of Sudden
Valley Subdivision for the minimum price of $933.94 plus costs
and further in this sale transferring to the owner all coal, oil,

gas, gravel, minerals, ores, fossils, timber or other resources o
or in said lands and the right to mine for and remove the same i
conformity with zoning regulations in force and effect;
BE IT FURTHER RESOLVED that it is the best interest of the
interest of the County to sell Lot 36, Division 5 of Sudden Valle
Subdivision for the minimum price of $781.06 plus costs and
further in this sale transferring to the owner all coal, oil, gas
gravel, minerals, ores, fossils, timber or other resources on or
in said lands and the right to mine for and remove the same in
conformity with zoning regulations in force and effect;
BE IT FURTHER RESOLVED that it is the best interest of the
interest of the County to sell Lot 75, Division 5 of Sudden Valle
Subdivision for the minimum price of $796.06 plus costs and
further in this sale transferring to the owner all coal, oil, gas
gravel, minerals, ores, fossils, timber or other resources on or
in said lands and the right to mine for and remove the same in
conformity with zoning regulations in force and effect;
BE IT FURTHER RESOLVED that it is the best interest of the
interest of the County to sell Lot 46, Division 7 of Sudden Valle
Subdivision for the minimum price of $1,154.51 plus costs and
further in this sale transferring to the owner all coal, oil, gas
gravel, minerals, ores, fossils, timber or other resources on or
in said lands and the right to mine for and remove the same in
conformity with zoning regulations in force and effect;
BE IT FURTHER RESOLVED that it is the best interest of the
interest of the County to sell Lot 54, Division 7 of Sudden Valle
Subdivision for the minimum price of $1,151.17 plus costs and
further in this sale transferring to the owner all coal, oil, gas
gravel, minerals, ores, fossils, timber or other resources on or
in said lands and the right to mine for and remove the same in
conformity with zoning regulations in force and effect;

BE IT FURTHER RESOLVED that this sale shall be subject to
the certification of the County Treasurer. Once the Treasurer
shall certify that the price set in this Resolution is the actual
amount of taxes which are owed to the County as provided for in
RCW 86.64.270, he shall direct the sale to take place;
BE IT FURTHER RESOLVED that said price shall not be allowed
under contract and shall be paid in either cash, certified check,
or money order to the Whatcom County Treasurer at the time of
sale;
BE IT FURTHER RESOLVED that the Whatcom County Treasurer is
hereby directed to sell such property at not less than a certi-
fied price and said sale shall take place in accordance with the
duties as established in RCW 84.64.270.
