INTRODUCED BY: Consent PROPOSED BY: County Exect DATE: November 17th, 1988 88 -66 A RESOLUTION IN THE MATTER OF CONTINUING THE COMBINED POSITION OF SUPERIOR COURT CLERK AND ASSISTANT TO SUPERIOR COURT, AND CONFIRMING APPOINTMENT OF N.F. JACKSON, JR. WHEREAS, in January, 1988, the County Council approved combining the position of Superior Court Clerk and Superior Court Assistant for the year 1988, subject to a Memorandum of Understanding between the Superior Court Judges and the County Executive; and, WHEREAS, the County Council confirmed the appointment by the County Executive of N.F. Jackson, Jr., to the position of Superior Court Clerk as required by the Whatcom County Charter, section 3.61, for one year; and, WHEREAS, this arrangement was to be reviewed and evaluated prior to November 1, 1988 and before consideration of extending the combined position and appointment; and, WHEREAS, such review and evaluation has been conducted and the recommendation is to continue the combined position; and, WHEREAS, the Superior Court Judges and the County Executive also concur with and endorse the recommendation, NOW, THEREFORE, BE IT RESOLVED that the continuation of the combined administration of the Superior Court and the County Clerk's offices provided for in the Memorandum of Understanding dated November 15, 1988, Entered into between the County Executive and the Superior Court, is hereby approved by the Whatcom County Council. BE IT FURTHER RESOLVED that the County Executive's appointment of N.F.. Jackson, Jr. to the position of County Clerk for the year 1989 is hereby confirmed. PASSED this 17th day of November 1988. MEMORANDUM OF UNDERSTAND =NG Between Whatcom County Executive and Whatcom County Superior Court November 15, 1988 WHEREAS the Whatcom County Executive and the Whatcom County Superior Court by Memorandum of Understanding dated January 15, 1988, agreed to combine the administration of the Superior Court and County Clerk by appointing a: single person to manage such offices, and, WHEREAS said Memorandum of Understanding provided for such appointment to 'be effective until December 31, 1988, unless continued by further joint act of the County Executive and the Superior Court, and, WHEREAS the review, evaluation and recommendation of the conduct of the work of the combined offices mandated by the Memorandum of Understanding of January 15, 1988, has been conducted and considered, NOW, THEREFORE, it is understood and agreed that it is in the interest of efficient management that the combination of offices under the direction of a single individual, as provided in the Memorandum of Understanding of January 15, 1988, shall continue, under the same conditions, until December 31, 1989, only, ! and shall terminate on that date unless continued by further joint act of the County Executive. and the Superior Court; that either the Superior Court or the County Executive may terminate this agreement, at will, prior to December 31, 1989; that this Memorandum of Understanding is subject to the a roval of the Whatcom County Council.
