A RESOLUTION TO SELL PROPERTY
5 ACQUIRED BY COUNTY ON TAX
6 FORECLOSURE
7 WHEREAS, RCW 84.64.270 allows the County to sell real estate
8 acquired by tax foreclosures where it is found to be in the best
9 interests of Whatcom County to sell the same; and,
10 WHEREAS, Whatcom County Council does deem it to be in the
11 County's best interest subsequent to a public hearing, to sell
12 a lot in Sudden Valley Subdivision which has been received
13 through tax foreclosure, specifically: Division 5, Lot 120, and
14 two (2) lots at Emerald Lake which have been received through tax
15 foreclosure, specifically: Division 3, Lot 58 and Lot 1; and,
16 WHEREAS, the Whatcom County Code as well as the state law
17 allows the County to reserve from the sale, coal, oil, gas,
18 gravel, minerals, ores, fossils, timber or other resources if the
19 Council finds that it is in the best interest to reserve these;
20 and,
21 WHEREAS, RCW 84.64 requires the Council to establish the
22 minimum price for said unit of property and to determine whether
23 or not a contract will be allowed or if it will be a cash price;
24 land,
NOW, THEREFORE, BE IT RESOLVED that it is in the best inter-
est of the County to sell Division 5, Lot 120 in Sudden Valley
Subdivision for the minimum price of $875.78 plus costs and
(further in this sale transferring to the owner all coal, oil, gas,
gravel, minerals, ores, fossils, timber or other resources on or
in said lands and the right to mine for and remove the same in

conformity with zoning regulations in force and effect; and,
BE IT FURTHER RESOLVED that it is in the best interest of
the County to sell Division 3, Lot 58 in Emerald Lake for the
minimum price of $623.62 plus costs and further in this sale
transferring to the owner all coal, oil, gas, gravel, minerals,
ores, fossils, timber or other resources on or in said
lands and the right to mine for and remove the same in conformity
with zoning regulations in force and effect; and,
BE IT FURTHER RESOLVED that it is in the best interest of
the County to sell Lot 1 in Emerald Lake for the minimum price of
$472.12 plus costs and further in this sale transferring to the
owner all coal, oil, gas, gravel, minerals, ores, fossils, timber
for other resources on or in said lands and the right to mine for
and remove the same in conformity with zoning regulations in force
and effect; and,
BE IT FURTHER RESOLVED that this sale shall be subject to
the certification of the County Treasurer. Once the Treasurer
shall certify that the price set in this Resolution is the actual
amount of taxes which are owed to the County as provided for in
RCW 86.64.270, he shall direct the sale to take place;
BE IT FURTHER RESOLVED that said price shall not be allowed
under contract and shall be paid in either cash, certified check,
or money order to the Whatcom County Treasurer at the time of
sale;
BE IT FURTHER RESOLVED that the Whatcom County Treasurer is
hereby directed to sell such property at not less than a certi-
fied price and said sale shall take place in accordance with the
duties as established in RCW 84.64.270.
