RESOLUTION NO. 89 -108
A RESOLUTION FIXING A TIME AND DATE FOR A
HEARING ON THE CREATION OF A SOLID WASTE
COLLECTION DISTRICT WITHIN THE UNINCORPORATED
AREA OF WHATCOM COUNTY
WHEREAS, Whatcom County has prepared a 1989 updated
Comprehensive Solid Waste Management Plan ( "Plan "); and
WHEREAS, the County has the public responsibility to foster
opportunities for waste reduction and recycling throughout the
County and to provide an equitable means for funding the County's
solid waste activities, in accordance with the goals of the Plan;
and
WHEREAS, the formation of a solid waste collection district
as provided in Chapter 36.58A RCW provides a means for
accomplishing the goals set forth in the Plan by providing for
mandatory collection of solid waste throughout the unincorporated
area of the County; and
WHEREAS, a public hearing is necessary and desirable to
ascertain whether mandatory solid waste collection is in the public
interest and necessary for the preservation of public health;
NOW, THEREFORE, BE IT RESOLVED by the Whatcom County Council
that:
The County Council shall conduct a hearing on the formation
of a solid waste collection district at o'clock .m. on
January 4, 1990, in the Council Chambers in the County Courthouse
in Bellingham, Washington. The district, if formed, shall include
all areas of unincorporated Whatcom County and shall be empowered
to enforce mandatory collection of solid waste within district
boundaries.
All persons who may desire to submit testimony regarding
formation of such a district are hereby notified to appear and
present such testimony at such hearing. The Clerk of the Council
is hereby directed to give notice, in the form attached, of said
hearing. Such notice shall be given by publication in the Westside
Record Journal and Lynden Tribune at least ten days prior to the
date of said hearing. Notice shall also be published, as
practicable, in any newspaper of record in the County. Copies of
the notice shall also be mailed to all mayors and city
councilmembers in the County, the Washington Utilities and
Transportation Commission, all companies engaged in solid waste

hauling, and other media who have requested to be advised of public
meetings of the County Council. The Clerk shall also arrange to
post such notice where appropriate in the County.
