HomeMy WebLinkAboutres1989-084a 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 PUBHEALTH. 989 INTRODUCED BY: Consent PROPOSED BY: County Executive DATE: 9 -21 -89 RESOLUTION NO. 89 -84 A RESOLUTION AUTHORIZING BINDING ARBITRATION TO DETERMINE EQUITABLE DIVISION OF` THE ASSETS OF THE WHATCOM COUNTY- BELLINGHAM PUBLIC HEALTH DISTRICT WHEREAS, the interlocal agreement which established the Whatcom County- Bellingham Public Health District provided in the event of one party withdrawing from the agreement all the assets of the District were to be divided in such a manner as to ensure the with- drawing party receives an equitable share of the assets or the cash equivalent; and, WHEREAS, the Whatcom County Council on June 30, 1988 by Resolution 68 -32 gave notice of its withdrawing from the District and by Or- dinance 89 -24 made the effective date March 31, 1989, at which time a county Department of Health was to be established; and, WHEREAS, analysis has been done and a report prepared of the re- spective contributions to the assets over the years and estimates given of the current value thereof; and, WHEREAS, there is a basic disagreement between the city and the county over the most appropriate way to determine the equitable share for distribution, but both do agree the most expedient way to resolve this issue is through binding arbitration; NOW, THEREFORE, BE IT }RESOLVED by the Whatcom County Council as follows: The County Executive is authorized to engage an arbitrator in con- junction with the City of Bellingham. The arbitrator will be mutually selected from a list of candidates proposed by both en- tities. The arbitrator will review all pertinent information related to the assets of the disbanded Whatcom County- Bellingham Public Health District and be presented with the respective positions of the City of Bellingham and Whatcom County as deemed appropriate. The arbitrator's decision on the division of the assets will be final and accepted by both parties.
