6 A RESOLUTION TO ACCEPT A PARTIAL PAYMENT
7 ON R.I.D. » 4 ASSESSMENT FOR BIRCH CREST
8 FISTATL'S DIVISION #1 TRACT A
9 WHEREAS, What.com County currently has an R.I.D. assessment
10 owing against Birch Crest. Estates Division 91 Tract A in the
11 amount of $48,121.69 (Forty right. Thousand One Hundred Twenty- One
12 Dollars and 69;100), which includes interest and penalties, and;
13 WHEREAS, The Birch Bay Water and Sewer District had a
14 substantial assessment lien against said property, and;
15
16 WHEREAS, Said property was appraised at $50,000.00 (Fifty
17 Thousand Dollars and no /100) and;
18 WHEREAS, Birch Bay Water and Sewer District purchased its
19 interests in th.e proper.t and attempted to sell the same and
20 after no bidders appeared said property was offered for sale for
21 more than 180 (One hundred Eighty) days during which time the
22 District received no offers at 90% of its appraised price, and;
23 WHEREAS, Resolution. 'No. 463 authorizes the Birch Bay Water
24 and Sewer District to sel-1 the property at any trice acceptable
25 to the Board of Commissioners, and;
26 WHEREAS, Birch Bay Water and Sewer District has received an
27 offer on this property for X35,000.00 (Thirty- Five '.Thousand
28 Dollars and no /100) , with the requirement that all construction
29 assessments be relinquished against said property, and;
30 WHEREAS, R.CW 36.32.120 states that the County Legislative
31 Authority "Have power to compound and release in -vchole or in part
32 any debt to the county when in their opinion the interest of
33 their county will not be prejudiced thereby, except in cases
34 where they or any of them are personally :interested ";

1 NOW, THEREFORE BE IT RESOLVED, that Whatcom County agrees to
accept the bid pr=ice of $35,000.00 (Thirty Five Thousand Dollars
3 and no /100), for Birch Crest Estates Division #1 Tract A, whereby
4 Whatcom County's share of sale is X16,544.36 (Sixteen Thousand
5 Five Hundred Forty Four Dollars and 36/100), for Road Improvement
6 District #4 Assessment. .Lien, and Whatcom County agrees that upon
7 payment of t.hi.s sum Whatcom County's lien will be estinquished
8 against. said property.
