HomeMy WebLinkAboutres1989-080INTRODUCED BY: Consent PROPOSED BY: County Ex cii -ivp 1 DATE: 9 -7 -89 2 3 4 RESOLUTION NO. 89 -80 5 6 A RESOLUTION OF WHATCOM COUNTY, WASHINGTON, DECLARING CERTAIN REAL PROPERTY SURPLUS AND 7 AUTHORIZING ITS SALE BY NEGOTIATION OR AUCTION IN COORDINATION WITH NOOKSACK, SUMAS AND. - 8 EVERSON 9 WHEREAS, by deed from the State of Washington dated 10 March 24, 1969" and recorded April 1, 1969, under Whatcom County Auditor's File No. 1058042, the then Town of Nooksack, 11 Town of Everson, Town of Sumas, and the Nooksack Township each acquired and undivided one- fourth interest in the following 12 described real property: 13 That portion of the Southeast quarter of the Northwest quarter AND THE Southwest quarter 14 of the Northeast quarter of Section 21, Township 40 North, Range 4 East of W.M., 15 described as follows: 16 Beginning at the Southeast corner of said Southeast quarter of the Northwest quarter; 17 thence Westerly along the Southerly line of said subdivision 328.58 feet to the true 18 point of beginning; thence North, 2 32'45" East, 1,213.77 feet; thence North, 47 07' 19 East, 114.92 feet; thence South 87 52' East, 343.59 feet; thence. South 2 52'00" West; 20 482.0 feet;,,t.h.ence- North 8.7 .12'45" West, 3.91.5..0. feet.. :the_nce.. ..'g.o.ut..h. :2.<.. 32,'.45.". We:st... 21 8.12.84 feet to the. Consisting. af,,5._16 23 acres, more or less. 24 WHEREAS, the undivided one - fourth interest'- of '. the 25 now - dissolved Nooksack Township is now held by Whatcom County; and, 26 WHEREAS, said real property is undeveloped and 27 unimproved, and is surplus to the foreseeable needs of Whatcom County; and, 28 - Resolution - 1. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 WHEREAS, it is. in the best interests of Whatcom County to coordinate the sale of said real property with the other -titleholding entities and to distribute the net proceeds of sale., together with the other monies of the same parties now held by _the Everson Clerk /Treasurer pursuant to the Intergovernmental Agreement dated December 22, 1969, to each of said parties in equal shares, after payment of. a state audit, the costs of sale and'any attorneys fees; NOW, THEREFORE, BE IT RESOLVED by the Whatcom County Council as follows; Section 1. The County's one - fourth interest in the real property described above is hereby declared surplus to the foreseeable needs of Whatcom County. Section 2. The Executive is authorized and directed to coordinate the sale of said real property interest with the Cities of Nooksack and Sumas, and Everson in the manner required by law and Chapter 36.34 RCW, and to execute any deeds, affidavits or other documentation necessary to effect such sale... Section 3. The Executive and •Treasurer are authorized and directed to (a) deposit the proceeds' of said sale in the escrow account established by and with the. Everson Clerk /Treasurer pursuant to the 1969 Intergovernmental Agreement between the respective titleholders or (b) to retain the proceeds of•said sale with the Whatcom County Treasurer upon such written instructions as received from the titleholders to this property. - Resolution - 2. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Section 4. A. I ..costs, of sale., including any escrow fees, title searches• or: insurance premiums fees, document preparation fees, private attorney's feesf and /or costs of publication of required notices, shall be. paid or reimbursed from the proceeds of said sale. Each titleholder shall bear the expense of its own legal counsel. Section 5. .Upon obtaining clearance. from the Washington Sate - Auditor, warrants.shall be presented effecting an equal divi.sion of the net monies if any exist between the City of Everson, City of Nooksack, City of Sumas and Whatcom County.
