5 TO SELL PROPERTY ACQUIRED BY COUNTY
6 ON TAX FORECLOSURE
7 REQUEST NO. 21
8 WHEREAS, RCW 84.64.270 allows the County to sell real estate
9 acquired by tax foreclosures where it is found to be in the best
10 interest of tti'hatcona,Countt- to sell the same; and,
1.1 WHEREAS, Whatcom County Council does deem it to be in the
12 County's best, interest to sell Lot 159, The Glen At Maple Falls,
13 Division #1, which has been received through tax foreclosure: and,
1.4 WHEREAS, -the Whatcom County Code as well as the state _lac.
15 allows the County to reserve from the sale, coal, oil, gas, gravel,
16 mineral, ores, fossils, timber or other resources if the Council.
17 finds that -it is in the best. interest to reserve these; and,
18 WHEREAS, the Whatcom Country Council has determined that it is
19 in the best interest of the County to sell said lot(s) subject to
a restrictive covena.nt allowing for imposition of Community
Association fees; and,
22 WHEREAS, RCW 84.64 requires the Council to establish -the
23 minimum price for said unit of property and to determine whether
24 or not a contract will be allowed or if it will be a cash price;
25 and,
26 WHEREAS, the Whatcom County Council deems that the price of
27 $840.00 is the minimum price for said lot (s) and that it is low
28 enough not to accept a contract, on this price but would be in the
29 County's best interest and the Council would_ require that this
30 amount, be paid in cash;
31 NOW, THEREFORE, BE IT RESOLVED that it is in the best interest
:32 of the County to sell Lot:. 159, The Glen at Maple Falls, Division
33 91, for the minimum price of $840.00, plus costs, and further in
34 this sale transferring to the owners all coal, oil, gas, gravel,
35 minerals, ores, fossils, timber or other resources on or in said
36 lands and the right Lo mine for and remove the same in conformity
37 with zoning regulations in ford= and effect.;
38 BE IT FURTHER RESOLVED that said lot(s) shall be sold subject
:39 to the restrictive covenant allowing for imposition of Community
40 Association fees as set forth in Whatcom County Resolution No. 88-
41 37;
42 BE IT FURTHER RESOLVED that this sale shall be subject to the
43 cerLificat,ion of.' the County Treasurer. Once the Treasurer shall
44 certify that the price set, in this Resolution is the actual amount
45 of taxes which are owed to the County as provided for in RCW
86.64.270, she sha.Ll direct the sale to take place;

BE IT FURTHER RESOLVED that said price shall not be allowed
under contract and shall he paid in either cash, certified check,
or money order to the Whatcom County Treasurer at the time of sale;
BE IT FURTHER RESOLVED that the Whatcom County- Treasurer is
hereby directed to sell such property at not lass than a certified
price and said sale shall. take place in accordance with the duties
as established in I;.CW 84.6 1.2 70.
