5 TO SELL PROPERTY ACQUIRED BY COUNTY
6 ON TAX FORECLOSURE , REQUEST N0. 15
7 WHEREAS, RCW 84.64.270 allows the County to sell real estate
8 acquired by tax foreclosures where it is found to be in the best
9 interest of Whatcom County to sell the same; and,
10 WHEREAS, Whatcom County Council does deem it to be in the
11 County's best interest to sell The Glen at Maple Falls Division #3,
12 Lot 89 which has been received through tax foreclosure;'and,
13 WHEREAS, the Whatcom County Code as well as the state law
14 allows the County to reserve from the sale, coal, oil, gas, gravel,
15° mineral, ores, fossils, timber or other resources if the Council
16' finds that it is in the best interest to reserve these; and,
17 WHEREAS, the Whatcom County Council has determined that it is
18 in the best interest of the County to sell said lot(s) subject to
19 a restrictive covenant allowing for imposition of Community
Association fees; and,
�1 WHEREAS, RCW 84.64 requires the Council to establish the
22 minimum price for said unit of property and to determine whether
23 or not a contract will be allowed or if it will be a cash price;
24 and,
25 WHEREAS, the Whatcom County Council deems that the price of
26 $868.55 is the minimum price for said lot(s) and that it is low
27 enough not to accept a contract on this price but would be in the
28 County's best interest and the Council would require that this
29 amount be paid in cash;
30 NOW, THEREFORE, BE IT RESOLVED that it is in the best interest
31 of the County to sell The Glen at Maple Falls Division #3 Lot 89
32 for the minimum price of $868.55, plus costs, and further in this
33 sale transferring to the owners all coal., oil, gas, gravel,
34 minerals, ores, fossils, timber or other resources on or in said
35 lands and the right to mine for and remove the same in conformity
36 with zoning regulations in force and effect;
37 BE IT FURTHER RESOLVED that said lot(s) shall be sold subject
38 to the restrictive covenant allowing for imposition of Community
39 Association fees as set forth in Whatcom County Resolution No. 88-
40 37;

.l BE IT FURTHER RESOLVED that this sale shall be subject to the
2 certification of the County Treasurer. Once the Treasurer shall
3 certify that the price set in this Resolution is the actual amount
4 of taxes which are owed to the County as provided for in RCW
5 86.64.270, she shall direct the sale to take place;
6 BE IT FURTHER RESOLVED that said price shall not be allowed
7 under contract and shall be paid in either cash, certified check,
8 or money order to the Whatcom County Treasurer at the time of sale;
9 BE IT FURTHER RESOLVED that the Whatcom County Treasurer is
10 hereby directed to sell such property at not less than a certified
11 price and said sale shall take place in accordance with the duties
12 as established in RCW 84.64.270.
