HomeMy WebLinkAboutres1989-0401 REQUEST NO. 14 INTRODUCED BY: Consent 2 PROPOSED BY: TREASURER 3 DATE: 4 -6 -89 4 RESOLUTION NO. 89 -40 5 TO SELL PROPERTY ACQUIRED BY COUNTY 6 ON TAX FORECLOSURE , REQUEST N0. 14 7 WHEREAS, RCW 84.64.270 allows the County to sell real estate 8 acquired by tax foreclosures where it is found to be in the best 9 interest of Whatcom County to sell the same; and, 10 WHEREAS, Whatcom County Council does deem it to be in the 11 County's best interest to sell Glenhaven Lakes Division 1, Block 12 1, Lot 21, Glenhaven Lakes Division 4, Block 1, Lot 3 and Glenhaven 13 Lakes Division 3, Block 2, Lot 1 which have been received through 14 tax foreclosure; and, 15';: WHEREAS, the Whatcom County Code as well as the state law 16 allows the County to reserve from the sale, coal, oil, gas, gravel, 17 mineral, ores, fossils, timber or other resources if the Council 18 finds that it is in the best interest to reserve these; and, 19 WHEREAS, the Whatcom County Council has determined that it is ?0 in the best interest of the County to sell said lot(s) subject to 1 a restrictive covenant allowing for imposition of Community 22 Association fees; and, 23 WHEREAS, RCW 84.64 requires the Council to establish the 24 minimum price for said unit of property and to determine whether 25 or not a contract will be allowed or if it will be a cash price; 26 and, 27 WHEREAS, the Whatcom County Council deems that the price of 28 $560.00, $810.00 and $710.00 is the minimum price for said lot(s) 29 and that it is low enough not to accept a contract on this price 30 but would be in the County's best interest and the Council would 31 require that this amount be paid in cash; 32 NOW, THEREFORE, BE IT RESOLVED that it is in the best interest 33 of the County to sell Glenhaven Lakes Division 1, Block 1, Lot 21 34 for the minimum price of $560.00, Glenhaven Lakes Division #4, 35 Block 1, Lot 3 for the minimum price of $810.00 and Glenhaven Lakes 36 Division 3, Block 2, Lot 1 for the minimum price of $710.00, plus 37 costs, and further in this sale transferring to the owners all 38 coal, oil, gas, gravel, minerals, ores, fossils, timber or other 39 resources on or in said lands and the right to mine for and remove 40 the same in conformity with zoning regulations in force and effect; 41 BE IT FURTHER RESOLVED that said lot(s) shall be sold subject 42 to the restrictive covenant allowing for imposition of Community 43 Association fees as set forth in Whatcom County Resolution No. 88- 44 37; 5 REQUEST NO. 14 PAGE NO. 1 .. r 1 BE IT FURTHER RESOLVED that this sale shall be subject to the 2 certification of the County Treasurer.
