DATE INTRODUCED: 4 -6 -89 RESOLUTION N0. 89 -36 A RESOLUTION ORDERING THE SEGREGATION OF CERTAIN ASSESSMENTS WITHIN ROAD IMPROVEMENT DISTRICT IVO. 8 . WHEREAS, the Whatcom County Council, on November 5, 1987, passed Ordinance No. 87 -66, created and formed Road Improvement District No. 8 ( "RID No. 8 ") for the purpose of undertaking maintenance of road and infrastruc- ture improvements within the Cordata Business Park; and WHEREAS, the County Council confirmed the assessment roll for RID No. 8 by Ordinance No. 87 -68, passed on November 5, 1987; and 11 WHEREAS, the County has received requests from the owners of certain property within RID No. 8 for the segregation of assessments for their respec- 12 �tive parcels; and 13 WHEREAS, a plan of segregation for such assessments substantially on the basis of the original assessments has been prepared; 14 NOW, THEREFORE, BE IT RESOLVED by the County Council of Whatcom County, 15 ias follows: 16 ; Section 1. The County has received an application for segregation of 17 �,certain tracts of property within RID No. 8, a copy of which is attached hereto !as Ex h1 bi t A. The total original assessment against said tracts was $ 16 , 800 , approved by Ordinance No. 87 -68. The County's Department of Public Works has 18 reviewed the plan of segregation and determined that segregation is appropriate and has been made as nearly as possible on the same basis as the original 19 assessment was levied. The plan of segregation for the assessments against the properties described in said application is set forth on Exhibit B, and the 20 1 otal of the segregated assessments provided for in the plan of segregation is 1equal to the original assessment levied therein. 21 1� 4 Section 2. The Clerk of the Council is hereby directed to deliver a 22 copy of this resolution, together with its attachments, to the Whatcom County reasurer and the Department of Public Works. Pursuant to the provisions of 23 rdinance No. 87 -55 of the County Council, the County Treasurer shall proceed to ake the segregation order in its records for RID No. 8, but such order shall be 24 onditioned upon receipt from the applicant for the plan of segregation a fee of 3.00 for each tract of land for which a segregation is to be made and further 25 onditioned upon the conditions outlined in Section 3 hereof, as required by 26 aid Ordinance No. 87 -55. 27 ESOLUTION - 1. 28 ate drafted: 4/3/89 29 I Section 3. This resolution ordering the plan of segregation is fully conditioned on the applicants' payment of all costs of the County, including 2 engineering, clerical and related costs incidental to making the segregation. The County Treasurer shall deposit the fees received and related engineering and 3 clerical costs in the RID No. 8 Fund created for receipt of payment of assessments within RID No. 8.
