RESOLUTION NO. 89 -28
CALLING FOR A SPECIAL ELECTION TO DETERMINE
WHETHER WATER DISTRICT 18 SHALL BE ESTABLISHED IN ACME
WHEREAS, a petition has been received requesting that an election be
called to determine whether Whatcom County Water District 18 should be formed,
to consist of a tract of land In a portion of Townships 37 and 38 North, Range
5 East of W.M., Whatcom County; and
WHEREAS, the County Auditor has certified that the petition is
sufficient, and a public hearing that was duly advertised as required by RCW
57.04 took place on April 6, 1989; and
WHEREAS, as a result of the hearing the County Council has determined
that a special election shall be ordered to take place;
NOW, THEREFORE, BE IT RESOLVED by the Whatcom County Council as follows:
Section 1. The proposed Water District No. 18 will be conducive to the
public health, welfare and convenience and be of special benefit to the land
Included within its boundaries, as described in Exhibit A, attached to this
resolution.
Section 2. A special election will take place on May 16, 1989, in order
to determine if the citizens within the proposed boundaries of Water District
18 wish to form said district. The proposition is hereby presented to the
Auditor's Office to be placed on the ballot as stipulated in RCW 57.04.050, as
follows:

Section 3. The voters within the proposed boundaries also will be asked
if they wish to authorize the water district, if formed, to levy a general tax
for one year for general preliminary expenses of the district on all property
located in the district. The tax would be levied at the earliest time
permitted by law. This proposition will be expressed on the ballot as
stipulated in RCW 57.04.050, as follows:

ONE YEAR, ONE DOLLAR AND TWENTY -FIVE CENTS PER
THOUSAND DOLLARS OF ASSESSED VALUE TAX
Shall Whatcom County Water District No. 18, If
it is formed, be authorized to levy a general tax for
one year on all property located within the district
boundaries, at the earliest time permitted by law, for
general preliminary expenses of the district, in an
amount not to exceed one dollar and twenty -five cents
per thousand dollars of assessed value?

Section 4. Election of commissioners for the Water District shall be
carried out as recommended by RCW 57.12, as follows:
A. Three water district commissioners shall be elected at the
same election at which the proposition to form a water district is
submitted to the voters. The commissioner elected to position one
shall hold office for six years, the commissioner elected to
position two shall hold office for four years, and the
commissioner elected in commissioner position three shall hold

3 office for two years. The members of the first commission shall
4 take office immediately upon their election and qualification.

6 B. Nominations for the first commissioners shall be by
7 petition. At least 25 percent of the district's qualified
8 electors, or 25 people (whichever is fewer) must sign a petition
9 nominating a person to a commissioner position in order for that
0 person to become a candidate. The petition shall be filed in the
1 Auditor's Office at least 30 days prior to the election (in this
2 case, no later than 4 :30 p.m. Friday, April 14).
C. Three individuals have already been nominated for the three
commissioner positions by petition as set forth above: Jim Baker
for position 1; Gary Smith for position 2; and Sara Galbraith for
position 3.
Section 5. Notice of this special election shall be published by
the Auditor's Office for four successive weeks In a newspaper of general
circulation In the proposed district, and the Auditor's Office staff shall
post notice of the special election for 10 days In 10 public places in the
proposed district, as required by RCW 57.04.
