HomeMy WebLinkAboutres1989-0191 2 3 4 5 6 7 8 9 10 11 12 13. 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 INTRODUCED BY: Consent PROPOSED BY: TREASURER DATE: February 16, 1989 RESOLUTION NO. 89 -19 A RESOLUTION TO SELL PROPERTY ACQUIRED BY COUNTY ON TAX FORECLOSURE REQUEST NO. 7 WHEREAS, RCW 84.64.270 allows the County to sell real estate acquired by tax foreclosures where it is found to be in the best interests of Whatcom County to sell the same; and, WHEREAS, Whatcom County Council does deem it to be in the County's best interest to sell Sudden Valley Division 39 Lot 107 and Sudden Valley Division 2, Lot 51 which have been received through tax foreclosure; and, WHEREAS, the Whatcom County Code as well as the state law allows the County to reserve from the sale, coal, oil, gas, gravel, minerals, ores, fossils, timber or other resources if the Council finds that it is in the best interest to reserve these; and, WHEREAS, the Whatcom County Council does deem it in the best interest of the County not to reserve these mineral rights, but rather to transfer them with the sale; and, WHEREAS, the Whatcom County Council has determined that it is in the best interest of the County to sell said lot(s) subject to a restrictive covenant allowing for imposition of Community Association fees; and, WHEREAS, RCW 84.64 requires the Council to establish the minimum price for said unit of property and to determine whether or not a contract will be allowed or if it will be a cash price; and WHEREAS, the Whatcom County Council deems that-the price of ($631.34 & $828.67 is the minimum price for said lots and that it is low enough not to accept a contract on this price but would be in the County's best interest and the Council would require that this amount be paid in cash; NOW, THEREFORE, BE IT RESOLVED that it is in the best interest of the County to sell Sudden Valley Division 3, Lot 107 for the minimum price of $631.34 plus costs and Sudden Valley Division 2, Lot 51 plus costs and further in this sale 1 transferring to the owner all coal, oil, gas, gravel, minerals, 2 ores, fossils, timber or other resources on or in said lands and 3 the right to mine for and remove the same in conformity with 4 zoning regulations in force and effect; 5 BE IT FURTHER RESOLVED that said lot(s) shall be sold 6 subject to the restrictive covenant allowing for imposition 7 of Community Association fees as set forth in Whatcom County 8 Resolution No. 88 -37; 9 BE IT FURTHER RESOLVED that this sale shall be subject to 10 the certification of the County Treasurer. Once the Treasurer 11 shall certify that the price set in this Resolution is the actual 12 amount of taxes which are owed to the County as provided for in 13. RCW 86.64.270, he shall direct the sale to take place; 14 BE IT FURTHER RESOLVED that said price shall not be allowed 15 under.contract and shall be paid in either cash, certified check, 16 or money order to the Whatcom County Treasurer at the time of 17 sale; 18 BE IT FURTHER RESOLVED that the Whatcom County Treasurer is 19 hereby directed to sell such property at not less than a 20 certified price and said sale shall take place in accordance with 21 the duties as established in RCW 84.64.270. 22 DATED this 17th day of March , 1988. 23 WHATCOM COUNT COUNCIL 24 HA COM COUN , A INGTON 26 onald G.
