HomeMy WebLinkAboutres1989-017r� `V 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 RESOLUTION NO. 89-17 A RESOLUTION OF THE WHATCOM COUNTY COUNCIL ORDERING THE SEGREGATION OF CERTAIN ASSESSMENTS WITHIN ROAD IMPROVEMENT DISTRICT NO. 8. WHEREAS, the Whatcom County Council, on November 5, 1987, passed Ordinance No. 87 -66, created and formed Road Improvement District No. 8 ( "RID No. 811) for the purpose of undertaking maintenance of road and infrastructure improvements within the Cordata Business Park; and WHEREAS, the County Council confirmed the assessment roll for RID No. 8 by Ordinance No. 87 -68, passed on November 5, 1987; and WHEREAS, portions of the property within RID No. 8 have been sold and final binding site plans filed in connection therewith, including the designation of all open space areas, and the County has received requests from the owners of certain property within RID No. 8 for the segregation of assessments for their respective parcels; and WHEREAS, a plan of segregation for such assessments substantially on the basis of the original assessments has been prepared; NOW, THEREFORE, BE IT RESOLVED BY THE COUNTY COUNCIL OF WHATCOM COUNTY, as follows: Section 1. The County has received an application for segregation of certain tracts of property within RID No. 8, 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 a copy of which is attached hereto as Exhibit A. The total original assessment against said tracts was $ 16,800 approved by Ordinance No. 87 -68. The County's Department of Public Works has reviewed the plan of segregation and determined that segregation has been made on as nearly as possible on the same basis as the original assessment was levied. The plan of segregation for the assessments against the properties described in said application is set forth on Exhibit B, and the total of the segregated assessments provided for in the plan of segregation is equal to the original assessment levied therein. Section 2. The Clerk of the Council is hereby directed to deliver a copy of this resolution, together with its attachments, to the Whatcom County Treasurer and the Department of Pubic Works. Pursuant to the provisions of Ordinance No. 87 -55 of the County Council, the County Treasurer shall proceed to make the segregation order in its records for RID No. 8, but such order shall be conditioned upon receipt from the applicant for the plan of segregation a fee of $3.00 for each tract of land for which a segregation is to be made and further conditioned upon the conditions outlined in Section 3 hereof, as required by said Ordinance No. 87 -55. Section 3. This resolution ordering the plan of segregation is fully conditioned on the applicants' payment of all costs of the County, including engineering, clerical - 2 - W5082- 88.001 -SEG8 1 2 3 4 5 6 7 8 9 10 12 13 14 15 16 17 18 19 20 21 and related costs incidental to making the segregation. The County Treasurer shall deposit the fees received and related engineering and clerical costs In the R.1 D. No. 8 Fund created for receipt of payment of assessments within R.1 D. No. 8. The foregoing fees shall be paid to the County Treasurer prior to the Treasurer's filing of the segregation order. It is further conditioned that all parcels, or portions of parcels in different taxing districts assessed at $2,000 or less be paid down provided the IIen rights can be applied to the total parcel, including the part paid down.
