2 A RESOLUTION TO SELL PROPERTY
ACQUIRED BY COUNTY ON TAX
3 FORECLOSURE
4 REQUEST NO. 4
5 WHEREAS, RCW 84.64.270 allows the County to sell real estate
6 acquired by tax foreclosures where it is found to be in the best
7 interests of Whatcom County to sell the same; and,
8 WHEREAS, Whatcom County Council does deem it to be in the
9 County's best interest to sell Sudden Valley Division #5, Lot 107
10
and Sudden Valley Division #3, Lot 162 which have been received
11
through tax foreclosure; and,
12
WHEREAS, the Whatcom County Code as well as the state law
13.
allows the County to reserve from the sale, coal, oil, gas,
14
gravel, minerals, ores, fossils, timber or other resources if the
15
Council finds that it is in the best interest to reserve these;
16
and,
17 WHEREAS, the Whatcom County Council does deem it in the best
18
interest of the County not to reserve these mineral rights, but
19
rather to transfer them with the sale; and,
20
WHEREAS, the Whatcom County Council has determined that it
21 is in the best interest of the County to sell said lot(s) subject
22
to a restrictive covenant allowing for imposition of Community
23
Association "fees; and,
24
WHEREAS, RCW 84.64 requires the Council to establish the
z5 minimum price for said unit of property and to determine whether
26
or not a contract will be allowed or if it will be a cash price;
27
and,
28 WHEREAS, the Whatcom County Council deems that the price of
29 $836.72 & $843.91 is the minimum price for said lots and that it.
30 is low enough not to accept a contract on this price but would be
31 in the County's best interest and the Council would require that
32 this amount be paid in cash;

NOW, THEREFORE, BE IT RESOLVED that it is in the best
interest of the County to sell Sudden Valley Division #5, Lot 107
for the minimum price of $836.72 plus costs and Sudden Valley
Division-43, Lot 162 for the minimum price of $843.91 plus costs

and further in this sale transferring to the owner all coal, oil,
2
gas, gravel, minerals, ores, fossils, timber or other resources
3
on or in said lands and the right to mine for and remove the same
4
in conformity with zoning regulations in force and effect;

BE IT FURTHER RESOLVED that said lot(s) shall be sold
6
7 subject to the restrictive covenant allowing for imposition
of Community Association fees as set forth in Whatcom County
8
9 Resolution No. 88 -37;
10 BE IT FURTHER RESOLVED that this sale shall be subject to
11 the certification of the County Treasurer. Once the Treasurer
12 shall certify that the price set in this Resolution is the actual
13. amount of taxes which are owed to the County as provided for in
14 RCW 86.64.270, he shall direct the sale to take place;
15 BE IT FURTHER RESOLVED that said price shall not be allowed
16 under contract and shall be paid in either cash, certified check,
17 or money order to the Whatcom County Treasurer at the time of
18 sale;
19 . BE IT FURTHER RESOLVED that the Whatcom County Treasurer is
20 hereby directed to sell such property at not less 'than a
21 certified price and said sale shall take place in accordance with
22 the duties as established in RCW 84.64.270.
