7 ON TAX FORECLOSURE
8 REQUEST NO. 48, 49, 50, 51, 52, 53, 54
WHEREAS, RCW 84.64.270 allows the County to sell real estate
acquired by tax foreclosures where it is found to be in the best
Interest of Whatcom County to sell the same; and,
WHEREAS, Whatcom County Council does deem it to be in the
County's best interest to sell Parcel ,O's 400522- 230250, 400522-
251248, 400522-245227, 380310- 491127, 400131-071361, 380310- 437169,
400522-223012; which have been received through tax foreclosure;
and,
WHEREAS, the Whatcom County Engineering, Public Works, Parks,
Planning and Assessor Departments were contacted and expressed no
interest in retaining these properties for County use; and
IrHEREAS, the Whatcom County Code as well as the state law
allows the County to reserve from the sale, coal, oil, gas, gravel,
mineral, ores, fossils, timber or other resources if the Council
finds that it is in the best interest to reserve these; and,
I REREAS, the Whatcom County Council has determined that it is
in the best interest of the County to sell said lot(s) subject to
a restrictive covenant allowing for imposition of Community
Association fees; and,
IrHEREAS, RCW 84.64 requires the Council to establish the
minimum price for said unit of property and to determine whether or
not a contract will be allowed or if it will be a cash price; and,
WHEREAS, the Whatcom County Council deems that the prices of
$3130. 95 for Parcel -0 400522- 230250, $3130. 95 for Parcel -0 400522-
251248, $4477.36 for Parcel 0 400522- 245227, $2346.86 for Parcel 0
380310-491127p $1470.60 for Parcel -0 400131 - 071361, $545.02 for
Parcel 0 380310- 437169, $8315. 22 for Parcel 0 400522- 223012 are the
minimum prices for said lot (s) and that it is low enough not to
accept a contract on this price but would be in the County's best
interest and the Council would require that this amount be paid in
cash;
ROW, THEREFORE, BE IT RESOLVED that it is in the best interest
of the County to sell Parcel ,O's 400522- 230250, 400522- 251248,
400522-245227p 380310- 491127, 400131-071361p 380310- 437169, 400522-
223012 for the minimum prices of $3130.95, $3130.95, $4477.36,
$2346.86p $1470.60p $545.02, $8315.22 plus costs and further in
this sale transferring to the owners all coal, oil, gas, gravel,
minerals, ores, fossils, timber or other resources on or in said
lands and the right to mine for and remove the same in conformity
with zoning regulations in force and effect;

BE IT FURTBER RESOLVED that said lot (s) shall be sold subject
to the restrictive covenant allowing for imposition of Community
Association fees as set forth in Whatcom County Resolution No. 88-
37;
BE IT FURTBER RESOLVED that this sale shall be subject to the
certification of the County Treasurer. Once the Treasurer shall
certify that the price set in this Resolution is the actual amount
of taxes which are owed to the County as provided for in RCW
86.64.270, she shall direct the sale to take place;
BE IT FURTHER RESOLVED that said price shall not be allowed
under contract and shall be paid in either cash, certified check,
or money order to the Whatcom County Treasurer at the time of sale;
BE IT FURTHER RESOLVED that the Whatcom County Treasurer is
hereby directed to sell such property at not less than a certified
price and said sale shall take place in accordance with the duties
as established in RCW 84.64.270.
