Yes l No /XI SUMMARY STATEMENT. • The County Treasurer requests a resolution from the Whatcom .County Council to petition the Superior Court of Wtiatcom County to finally cancel and completely extinquish the lien of delinquent personal property taxes "EXHIBIT A". The Treasurer or her assigned deputies have made diligent search and inquiry to collect the tax assessed, but for reasons stated in "EXHIBIT A" have been unable to make collection. R 90 -52 1 SPONSORED BY: Consent 2 PROPOSED BY: Treasurer 3 INTRODUCTION DATE: 7 -24 -90 4 RESOLUTION NO. 90 -52 5 A RESOLUTION IN THE MATTER OF CANCELLATION OF 6 UNCOLLECTIBLE PERSONAL PROPERTY TAXES MORE THAN. 7 FOUR YEARS DELINQUENT 8 WHEREAS, the County Treasurer has filed with the County Auditor a list of 9 personal property taxes which the Treasurer is unable for want of goods or chattels 10 whereupon to levy, to collect by distraint or otherwise; which list is accompanied with an 11 affidavit of herself and the Deputy Treasurer entrusted with the collection of said taxes, 12 stating that he had made diligent search and inquiry for goods and chattels wherewith 13 to make such taxes, and was unable to collect same; and 14 WHEREAS, such list and affidavit have been timely delivered to the County 15 Council; and 6 WHEREAS, based upon the Treasurer's Affidavit, the County Council finds that 17 such taxes are beyond hope of collecting, and their cancellation will not impair the 18 obligation of any bond issue nor is cancellation precluded by any other legal impediment 19 that might invalidate such cancellations; 20 NOW, THEREFORE, THE COUNTY COUNCIL approves the Treasurer's 21 request for cancellations of these personal property taxes listed in the affidavit dated July 22 16, 1990 as being more than four (4) years delinquent and beyond hope of collection; 23 BE IT FURTHER RESOLVED that the Treasurer is authorized to petition the 24 Superior Court of Whatcom County to finally cancel and completely extinguish the lien 25 of such uncollectible personal property taxes and take all necessary steps under the law 26 to secure and order of the court cancelling said uncollectible taxes and extinguishing the 7 lien thereof.
