This resolution involves property described as follows: The property in
question is Parcel #400321 - 129556, A tract of land located in Section 21,
Township 40 North, Range 3 East of W.M.: Beginning on the Easterly line of
Government Lot 1, Northerly line of County Road 28; thence Westerly along
said road 100 feet; thence North parallel to the East line of said Government
Lot 1 to the Southerly line' of the Chicago Milwaukee St. Paul and Pacific
Railroad right -of -way; thence Easterly on the Railroad said right -of -way line
to the East line of said Government Lot 1; thence South to the point of
beginning, per CVL 44012
RECOMMENDED ACTION.-
Following the hearing, the Treasurer recommends that the resolution be
passed.

7 WHEREAS, RCW 36.34.010 allows the County to sell real estate belonging to the
8 County where it is found to be in the best interest of Whatcom County to sell the same;
9 and,
10 WHEREAS, Whatcom County Council does deem it to be in the County's best
11 interest to sell Parcel # 400321 129556, A tract of land located in Section 21, Township
12 40 North, Range 3 East of W.M.: Beginning on the Easterly line of Government Lot 1,
13 Northerly line of County Road 28; thence Westerly along said road 100 feet; thence
14 North parallel to the East line of said Government Lot 1 to the Southerly line of the
15 Chicago Milwaukee St. Paul and Pacific Railroad right -of -way; thence Easterly on
16 Railroad of said right -of -way line to the East line of said Government Lot 1; thence
17 South to the point of beginning, per CVL 44012, and,
8 WHEREAS, the Whatcom County Engineering, Pubic Works, Parks, Planning and
19 Assessor Departments were contacted and expressed no interest in retaining this property
20 for County use; and
21 WHEREAS, the Whatcom County Code as well as the state law allows the County
22 to reserve from the sale, coal, oil, gas, gravel, mineral, ores, fossils, timber or other
23 resources if the Council finds that it is in the best interest to reserve these; and,
24 WHEREAS, the Whatcom County Council has determined that it is in the best
25 interest of the County to sell said lot(s) subject to a restrictive covenant allowing for
26 imposition of Community Association fees; and,
27 WHEREAS, RCW 84.64 requires the Council to establish the minimum price for
28 said unit of property and to determine whether or not a contract will be allowed or if
29 it will be a cash price; and,
30 WHEREAS, the Whatcom County Council deems that the price of $12,500.00 for
31 Parcel #400321 - 129556 is the minimum price for said lot(s) and that it is low enough not
32 to accept a contract on this price but would be in the County's best interest and the
33 Council would require that this amount be paid in cash;
34 SALE REQUEST NO. 40 PAGE NO. 1
1 NOW, THEREFORE, BE IT RESOLVED that it is in the best interest of the
2 County to sell Parcel #400321 - 129556 for the minimum price of $12,500.00 plus costs and
3 further in this sale transferring to the owners all coal, oil, gas, gravel, minerals, ores,
4 fossils, timber or other resources on or in said lands and the right to mine for and
5 remove the same in conformity with zoning regulations in force and effect;
6 BE IT FURTHER RESOLVED that said lot(s) shall be sold subject to the
7 restrictive covenant allowing for imposition of Community Association fees as set forth
8 in Whatcom County Resolution No. 88 -37;
9 BE IT FURTHER RESOLVED that this sale shall be subject to the certification
10 of the County Treasurer. Once the Treasurer shall certify that the price set in this
11 Resolution is a reasonable price for this property, she shall direct the sale to take place;
12 BE IT FURTHER RESOLVED that said price shall not be allowed under contract
13 and shall be paid in either cash, certified check,
14 or money order to the Whatcom County Treasurer at the time of sale;
15 BE IT FURTHER RESOLVED that the Whatcom County Treasurer is hereby
16 directed to sell such property at not less than a certified price and said sale shall take
17 place in accordance with the duties as established in RCW 36.34.010.
