Ordinance or Resolution Number: Res 90 -47 1 INTRODUCED BY: 2 PROPOSED BY: TREASURER 3 DATE: 1 -10 -90 4 RESOLUTION NO. 90 -47 5 TO SELL PROPERTY ACQUIRED BY COUNTY 6 ON TAX FORECLOSURE 7 REQUEST NO. 36, 37, 39, 41, 42, 43, 44, 45, 46, 47 s WHEREAS, RCW 84.64.270 allows the County to sell real estate acquired by tax 9 foreclosures where it is found to be in the best interest of Whatcom County to sell the 10 same; and, 11 WHEREAS, Whatcom County Council does deem it to be in the County's best 12 interest to sell Parcel #'s 400336 - 478174, 400522- 219089, 400522- 156158, 400522- 166263, 13 400522- 159263, 380104- 495125, 400522- 251080, 400522- 229211, 400522- 172154, 400522- 14 162241; which have been received through tax foreclosure; and, 15 WHEREAS, the Whatcom County Engineering, Pubic Works, Parks, Planning and 16 Assessor Departments were contacted and expressed no interest in retaining these 17 properties for County use; and 18 WHEREAS, the Whatcom County Code as well as the state law allows the County q to reserve from the sale, coal, oil, gas, gravel, mineral, ores, fossils, timber or other J resources if the Council finds that it is in the best interest to reserve these; and, 21 WHEREAS, the Whatcom County Council has determined that it is in the best 22 interest of the County to sell said lot(s) subject to a restrictive covenant allowing for 23 imposition of Community Association fees; and, 24 WHEREAS, RCW 84.64 requires the Council to establish the minimum price for 25 said unit of property and to determine whether or not a contract will be allowed or if 26 it will be a cash price; and, 27 WHEREAS, the Whatcom County Council deems that the prices of $1500.00 for 28 Parcel # 400336 - 478174, $3500.00 for Parcel # 400522- 219089, $3200.00 for Parcel # 29 400522- 156158, $4001.00 for Parcel #400522- 166263, $4110.00 for Parcel #40522- 159263, 30 $700.00 for Parcel # 380104- 495125, $3400.00 for Parcel # 400522- 251080, $1500.00 for 31 Parcel # 400522- 229211, $1000.00 for Parcel # 400522- 172154, $2101.00 for Parcel # 32 400522- 162241, are the minimum prices for said lot(s) and that they are low enough not 33 to accept contracts on these prices but would be in the County's best interest and the 34 Council would require that these amounts be paid in cash; 35 SALE REQUEST NO. 36, 37, 39, 41, 42, 43, 44, 450 46, 47 PAGE NO. -I 1 NOW, THEREFORE, BE IT RESOLVED that it is in the best interest of the 2 County to sell Parcel Ws 400336 - 478174, 400522- 219089, 400522- 156158, 400522- 166263, 3 400522- 1592639 380104- 495125, 400522 - 251080, 400522- 229211, 400522 - 172154, 400522- 4 162241, for the minimum prices of $1500.00, $3500.00, $3200.00, $4001.00, $4110.00, 5 $700.00, $3400.00, $1500.00, $1000.00, $2101.00, plus costs and further in this sale 6 transferring to the owners all coal, oil, gas, gravel, minerals, ores, fossils, timber or other 7 resources on or in said lands and the right to mine for and remove the same in 8 conformity with zoning regulations in force and effect; 9 BE IT FURTHER RESOLVED that said lot(s) shall be sold subject to the 10 restrictive covenant allowing for imposition of Community Association fees as set forth 11 in Whatcom County Resolution No. 88 -37; 12 BE IT FURTHER RESOLVED that this sale shall be subject to the certification 13 of the County Treasurer.
