R 90 -38 .1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 INTRODUCED BY: Consent PROPOSED BY: Executive DATE: 3 =27 -90 RESOLUTION NO.-90-38 RESOLUTION AUTHORIZING THE SALE OF COUNTY OWNED PROPERTY THROUGH THE PUBLIC AUCTION PROCESS WHEREAS, the County has held a public hearing on the below described property; and, WHEREAS, it was shown that Whatcom County does own the property and that the property no longer is needed for a public purpose; and, WHEREAS, there has been an interest in the property. NOW, THEREFORE BE IT RESOLVED that the property located adjacent to the Cedarville Landfill, more particularly described as follows: Beginning at the Southeasterly corner of a tract of land conveyed to George T. Cowden and Pearl Cowden, his wife, by Deed dated March 12, 19S1, filed March 13, 19S1, as Auditor's File No. 713984; thence running Northerly along the East line 600 feet; thence at right angles to a point on the West line of same; thence Southerly to the Northeasterly line of the Chicago, Milwaukee, St. Paul and Pacific Railroad Company's right -of -way;. thence Southeasterly on the Northeasterly line of the Chicago Milwaukee, St. Paul and Pacific Railroad Company's right -of -way to point of beginning. EXCEPT: Any portion of the parcel conveyed to Leonard Cowden by Whatcom County under A.F. 1412183 LESS ROAD EASEMENT. Both properties located in - Resolution - 1. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Section 28, Township 39 North, Range 4E. of W.M. is owned by Whatcom County. BE IT FURTHER RESOLVED that the Whatcom County Council has held a public hearing to determine whether this property shall be declared surplus. BE IT FURTHER RESOLVED that as a result of that public hearing the Whatcom County Council has determined that the property is not necessary for the future use of the Cedarville Landfill. It has no other public use. BE IT FURTHER RESOLVED that the Whatcom County Council hereby declares that the property is surplus and can be transferred. Therefore the Whatcom County Council hereby directs the Whatcom County Treasurer to sell this property at a public auction to the highest and best bidder; at a location and time determined by the Treasurer. BE IT FURTHER RESOLVED that it would not be in the public's best interest to sell this property for less than Three Thousand Dollars ($3,000.00) and- therefore the Whatcom County Treasurer is directed to start the bidding at that price.
