A resolution authorizing the-County Prosecuting Attorney's office to proceed with
legal action to acquire a parcel of land by condemnation.

SUMMARY STATEMENT:
Whatcom County has received Federal RRP funds for the signalization of East
Badger Road Railroad Crossing and to relocate the Garrison /East Badger intersec-
tion easterly from its present location to improve the safety of the railroad
crossing. An agreement cannot be reached with the involved property owner to
purchase said right -of -way.
RECOMMENDED ACTION:
To proceed with legal action to acquire the required right -of -way by condem-
nation.

RESOLUTION NO. 90 -37
A RESOLUTION AUTHORIZING THE COUNTY PROSECUTING ATTORNEY'S
OFFICE TO PROCEED WITH LEGAL ACTION TO ACQUIRE A PARCEL OF LAND CONSISTING
OF APPROXIMATELY 0.30 ACRES, LOCATED AT THE SOUTHEAST CORNER OF THE
INTERSECTION OF GARRISON ROAD WITH EAST BADGER ROAD,
BY CONDEMNATION
WHEREAS, Whatcom County has received Federal RRP funds for the signaliza-
tion of the East Badger Road railroad crossing, and
WHEREAS, WSDOT requires the consolidation of the existing two railroad
crossings in this vicinity into one crossing, by relocating the Garrison /East
Badger intersection approximately 325 feet east of its present location, and
WHEREAS, WSDOT has authorized Whatcom County to acquire the right -of -way
necessary to construct said improvements, and
WHEREAS, an agreement cannot be reached with the involved property owner
to purchase said right -of -way.
NOW, BE IT RESOLVED, that the County Council does hereby authorize the
County Prosecuting Attorney's office to proceed with legal action to acquire
said parcel of land, for the purpose stated herein by condemnation.
