R 90 -34 1 2 3 0 5 6 7 INTRODUCED BY: Consent PROPOSEDBY: TREASURER DATE: T--2 - 9 0 RESOLUTION NO. 90-34 TO SELL COUNTY OWNED PROPERTY REQUEST NO. 35 WHEREAS, RCW 36.34.010 allows the County to sell real estate belonging to the County where it is found to be in the best interest of Whatcom County- to sell the same; and, WHEREAS, Whatcom County Council does deem it to be in the County's best interest to sell Parcel 4 390707- 439554, TOWN OF GLACIER, BLE. , 3 WLY 25 FT LOT 2 -SUBJ TO ESMTS FOR WATER RTS -PIPE LI DESC IN 16 -D -195 16 -D -231; and, WHEREAS, the Whatcom County Engineering, Pubic Works, Parks, Planning and Assessor Departments were contacted and expressed no interest in retaining this property for County use; and WHEREAS, the Whatcom County Code as well as the state law allows the County to reserve from the sale, coal, oil, gas, gravel, mineral, ores, fossils, timber or other resources if the Council finds that it is in the best interest to reserve these; and, WHEREAS, the Whatcom County Council has determined that it is in the best interest of the County to sell said lot(s) subject to a restrictive covenant allowing for imposition of Community Association fees; and, WHEREAS, RCW 84.64 requires the Council to establish the minimum price for said unit of property and to determine whether or not a contract will be allowed or if it will be a cash price; and, WHEREAS, the Whatcom County Council deems that the price of $500.00 for Parcel #390707- 439554 is the minimum price for said lot(s) and that it is low enough not to accept a contract on this price but would be in the County's best interest and the Council would require that this amount be paid in cash, NOW, THEREFORE, BE IT RESOLVED that it is in the best interest of the County to sell Parcel #390707- 439554 for the minimum price of $500.00 plus costs and further in this sale transferring to the .owners all coal, oil, gas, gravel, minerals, ores, fossils, timber or other resources on or in said lands and the right to mine for and remove the same in conformity with zoning regulations in force and effec t; BE IT FURTHER RESOLVED that said lot(s) shall be sold subject to the restrictive covenant allowing for imposition of Community Association fees as set forth in Whatcom County Resolution No. 88 -37; BE IT FURTHER RESOLVED that this sale shall be subject to the certification of the County Treasurer. Once the Treasurer shall certify that the price set in this Resolution is a reasonable price for this property, she shall direct the sale to take place; 44 SALE REQUEST NO. 35 PAGE NO. 1 BE IT FURTHER RESOLVED that said price shall not be allowed under contract 2 and shall be paid in either cash, certified check, 3 or money order to the Whatcom County Treasurer at the time of sale; 4 BE IT FURTHER RESOLVED that the Whatcom County Treasurer is hereby 5 directed to sell such property at not less than a certified price and said sale shall 6 take place in accordance with the duties as established in RCW 36.34.010. f1 8 9 10 11 12 13 14 15 APPROVED this 24th day of ATTEST: mona Reeves, Council Clerk APPROVED AS TO FORM.
