SUMMARY STATEMENT-
You may recall the "water disaster" in Acme where the ground water supply became contamina-
ted due to. leaking gas tank. The use of water from that supply had to be immediately discon-
tinued. The county agreed to admininster an imminent threat grant from the federal government
to finance the construction of a well. That well has been constructed and is now operating.
Management of that well should rightfully belong to the Water:.District, and this resolution
makes the transfer official.

RESOLUTION No. 90 -31
A RESOLUTION IN THE MATTER OF
TRANSFERRING A WELL AND RELATED IMPROVEMENTS
IN ACME, WASHINGTON, TO WATER DISTRICT #18
WHEREAS, Whatcom County agreed to administer a Federal Imminent Threat
Grant for the Acme community to replace the community well that had been
contaminated by petroleum products; and
WHEREAS, the grant is now completed and the County was required under
the grant to take ownership of the well improvements; and
WHEREAS, the County has no interest in continued ownership of the well
improvements, since they were designed to benefit the Acme community solely; and
WHEREAS, continued ownership of the well and appurtenances presents a
liability to the County, and the ownership and maintenance are properly
responsibilities of the recently formed Water District # 18;
WHEREAS, a public hearing on the matter of declaring said well and
appurtenances surplus was held on the 10th day of April, 1990 at 7:00 p.m.;
NOW, THEREFORE BE IT RESOLVED, by the Council of Whatcom County,
Washington, that said well and appurtenances are hereby declared surplus, and the
County Executive shall be authorized to transfer the property to Water District #18
for a fee of one dollar.
