Yes No / f SUMMARY STATEMENT.• Resolution authorizes Prosecuting Attorney to petition Superior Court for decree to accomplish transfer or exchange of a 6.9 acre parcel of County -owned property for a property of equal size and value privately owned by :Trillium Corporation. Said County - owned property was previously deeded to County by Trillium to be used as site of juvenile detention facility and is no longer needed for that purpose. INTRODUCED BY: Consent PROPOSED BY: Executive DATE: 3/27/90 RESOLUTION NO. 90 -26 RESOLUTION AUTHORIZING THE PROSECUTING ATTORNEY'S OFFICE TO SEEK A PETITION IN SUPERIOR COURT TO AUTHORIZE THE TRANSFER OF PUBLIC -OWNED PROPERTY FOR PRIVATE -OWNED PROPERTY OF EQUAL VALUE. WHEREAS, Whatcom County presently owns a parcel of land in the Cordata Business Park, a tract of land situated in Block 71, Bakerview Addition in the City of Bellingham, Whatcom County, Washington, containing 6.9 acres, according to the plat thereof recorded in Volume 7 of Plats, Auditor's No. 2559412, and WHEREAS, this real property has never been utilizied by the County for public purposes but remains public -owned property, and WHEREAS, the Trillium Corporation conveyed said property to Whatcom County for public use, and WJHEREAS, now said property shall not be utilized by the public for the purpose for which it was intended, and WHEREAS, the best interest of the public would be to exchange or transfer said County -owned property for a privately -owned property of equal size and value, and WHEREAS, the property owner has agreed to such an exchange and to deed such a property to the County in exchange for the County -owned property. In order to accomplish this, it requires a decree from the Superior Court. NOW, THEREFORE, BE IT RESOLVED that: The Whatcom County Council hereby authorizes the Prosecutor's Office to file a Petition in the Superior Court for Whatcom County to seek the transfer or exchange of this county property for private property of equal value.
