RESOLUTION NO.-90-22
RESOLUTION AUTHORIZING THE PROSECUTING
ATTORNEY'S OFFICE TO SEEK A PETITION IN
SUPERIOR COURT TO AUTHORIZE THE TRANSFER
OF PUBLIC RIGHT -OF -WAY FOR PRIVATE PROPERTY
OF EQUAL VALUE
WHEREAS, Whatcom County presently has a thirty foot
right -of -way within the Watkin's Lake Front Addition
Supplemental to West Geneva; which runs parallel to Lot No. 4;
and,
WHEREAS, this right -of -way has never been opened or
utilized by the public, but remains a right -of -way today by
virtue of the platting; and,
WHEREAS, some thirty (30) years ago a home was
constructed on the right -of -way by the prior owner; and,
WHEREAS, now, through no fault of the present owner,
this right -of -way could not be used by the public without
demolishing the house; and,
WHEREAS, the best interest of the public would be to
vacate this right -of -way except for the fact 'that state law
prohibits its vacation since it abuts water; and,
WHEREAS, the owner of this property has agreed to
purchase tidelands at another location, and deed it to the
County in exchange for this right -of -way. In order to
accomplish this it requires a decree from the Superior Court.
NOW, THEREFORE, BE IT RESOLVED that:
The Whatcom County Council hereby authorizes the
Prosecutor's Office to file a Petition in the Superior Courtl
