Yes /x Y No /� SUMMARY STATEMENT: The Acme well replacement project conducted with an Imminent Threat Grant by Whatcom County is now complete. The county wishes to turn the well over to Water District No. 8. Holding a hearing to declare the property surplus must first take place according to state law. This resolution begins that process. Numbers: Ordinance or Resolution Number: R 90 -18 1 Acmewel.sur INTRODUCED BY: Consent PROPOSED BY: Executive DATE: 3 -13 -90 RESOLUTION No. 90 -18 A RESOLUTION IN THE MATTER OF SETTING A DATE FOR PUBLIC HEARING FOR DECLARING A WELL AND RELATED IMPROVEMENTS IN ACME, WASHINGTON, SURPLUS PURSUANT TO RCW 39.33.020 WHEREAS, Whatcom County agreed to administer a Federal Imminent Threat Grant for the Acme community to replace the community well that had been contaminated by petroleum products; and WHEREAS, the grant is now completed and the County was required under the grant to take ownership of the well improvements; and WHEREAS, the County has no interest in continued ownership of the well improvements, since they were designed to benefit the Acme community solely; and WHEREAS, continued ownership of the well and appurtenances presents a liability to the County, and the ownership and maintenance are properly responsibilities of the recently formed Water District # 18; NOW, THEREFORE BE IT RESOLVED, by the Council of Whatcom County, Washington, that a public hearing on the matter of declaring said well and appurtenances surplus shall be held on the 24th day of April , 1990 at 7:00 p.m., or as soon thereafter as possible, in the Whatcom County Council Chambers, second floor, Whatcom County Courthouse, Bellingham, Washington, for the purpose of admitting testimony for and against the surplusing of said property.
