SUMMARY STATEMENT.•
This resolution accomplishes the preliminary work toward getting a solid waste
disposal excise tax to provide a source of revenue for solving solid waste problems
in Whatcom County by setting a public hearing.
RECOMMENDED ACTION.•
Recommendat: that the Resolution be passed.

RESOLUTION NO. 90 -8
A RESOLUTION FIXING A TIME AND DATE FOR A
HEARING ON THE FIXING OF A TAX RATE FOR THE
SOLID WASTE DISPOSAL EXCISE PRIVILEGE TAX BY
THE WHATCOM COUNTY SOLID WASTE DISPOSAL
DISTRICT PURSUANT TO COUNTY ORDINANCE NO. 90 -1
AND INTERLOCAL AGREEMENTS BETWEEN WHATCOM
COUNTY AND CITIES AND TOWNS LOCATED WITHIN
WHATCOM COUNTY.
WHEREAS, Whatcom County has adopted a 1990 updated
Comprehensive Solid Waste Management Plan ( "Plan "); and
WHEREAS, the County has the responsibility to implement the
goals of the Plan, including, but not limited to, waste reduction
and recycling programs, construction of transfer stations, and
development, maintenance, operation, and closure of county -owned
landfills; and
WHEREAS, the County must have a stable and reliable source of
income in order to implement the goals of solid waste disposal as
set forth in the Plan; and
WHEREAS, the County has exercised its authority under Chapter
36.58 RCW to create the Whatcom County Solid Waste Disposal
District ("District ") for the purpose of providing and funding
solid waste disposal services; and
WHEREAS, RCW 36.58.100 provides that the County legislative
authority shall be the governing body of a solid waste disposal
district; and
WHEREAS, the County has, pursuant to interlocal agreements
with cities comprising all incorporated areas of the County, to
wit, Bellingham, Blaine, Everson, Ferndale, Lynden, Nooksack, and
Sumas, included such cities and towns, respectively, in the
District; and
WHEREAS, the County shall submit the annual solid waste budget
to the mayors of each city in the County for their review of the
use of tax proceeds, as provided in the interlocal agreements; and
WHEREAS, solid waste disposal districts are authorized by
Chapter 36.58 RCW to impose fees and to levy and collect an excise

privilege tax for the purpose of funding solid waste disposal
activities; and
WHEREAS, a public hearing is necessary and desirable to
ascertain at what rate the District should impose the solid waste
privilege tax in order to serve the public interest and Plan
objectives;
NOW, THEREFORE, BE IT RESOLVED by the Whatcom County Council,
convened as the governing body of the Whatcom County Solid Waste
Disposal District, that:
The governing body of the Solid Waste Disposal District shall
conduct a hearing on the rate of the tax to be imposed by said
solid waste disposal district at -Z:_ o'clock m. on February M
1990, in the Council Chambers in the County Courthouse in
Bellingham, Washington. The Whatcom County Public Works Department
and the Whatcom County Executive have proposed that the rate of the
excise tax on the privilege of living in or operating a business
in the District be set at 10% (ten per cent) of the charges imposed
by certificated or franchised haulers of solid waste for solid
waste collection service in the District from residential, business
and institutional customers.
All persons who may desire to submit testimony regarding the
rate of such tax are hereby notified to appear and present such

testimony at such hearing. The Clerk of the Council is hereby
directed to give notice, in the form attached, of said hearing.
Such notice shall be given by publication in the Westside Record
Journal and Lynden Tribune at least ten days prior to the date of
said hearing. Notice shall also be published, if practicable, in
any newspaper of record in the County. Copies of the notice shall
also be mailed to all mayors and city councilmembers in the County,
all companies engaged in solid waste hauling, and other media who
have requested to be advised of public meetings of the County
Council. The Clerk shall also arrange to post such notice where
appropriate in the County.
