SUMMARY STATEMENT. -
This policy is proposed in response to Roederland residents' request for asphalt in
lieu of chip seal in their housing development. The resolution seeks a fair resolution
to the request and proposes cost sharing to defray additional cost of special treatment.

In the matter of a Policy
for Substituting 1 1/2 inch overlay
in lieu of County Standard Chip Seal Applications
in Certain Subdivisions
WHEREAS, Whatcom County has adopted the application of "chip seal"
as its road maintenance standard; and,
WHEREAS, "chip seal" treatment has been very successful and cost
effective in the County road maintenance program when applied on
a 7 -10 year frequency; and,
WHEREAS, certain subdivisions within Whatcom County feel the
surface produced by chip sealing is too rough when compared to 1
1/2 -inch of asphalt overlay; and,
WHEREAS, two applications of chip seal will have approximately the
same life expectancy as 1 1/2- inches of asphalt overlay,
NOW, THEREFORE, BE IT RESOLVED that Whatcom County adopts as a
policy that residents of rural residential (subdivision)
developments may request the County to pave their roads with a 1
1/2 -inch asphalt overlay in lieu of chip sealing. Because this is
a standard higher than that generally used by the County for road
maintenance, residents will be required to pay a fair share of the
added cost.
BE IT FURTHER RESOLVED that the procedure for implementation of
this policy will be as outlined in Exhibit A, attached to and
incorporated herein by reference.

Procedure For Handling Requests For Asphalt
In Lieu Of Chip Sealing
On Roads In Rural Residential Developments
Each season, the County will notify residents of subdivisions scheduled for chip sealing
as soon as the proposed road list is finalized. Residents will have 30 days to contact
the County's Maintenance and Operations Division to request an asphalt overlay in lieu
of the chip sealing. Residents at the time of contact must give the County the name(s)
and phone number(s) of their official contact person(s) to assure a good flow of
information.
The County will provide to the residents the cost figures of an asphalt overlay, the
amount of the chip seal credit, and the cost per residence that would be required to
asphalt. Residents must submit to the County the signed concurrence of a minimum of
75% of the residents to share the cost of the asphalt lift within two weeks of receiving
the cost figures from the County.
Under the formula to be utilized, the residents will receive a two to one credit due to
the life expectancy of each type of surface treatment. This will be based on the
assumption of a ten -year life for chip seal surface treatment, and twenty -year life for
asphalt. Both assumptions were based on the type of traffic in a residential area, and
that the road base is adequate.
Residents will be given two years to make payment to the County for the cost difference.
The County will front the initial cost. A signed agreement will be executed by the
County with each party, calling for a lien against the property for failure to pay.
