SUMMARY STATEMENT.-
Councilman Dan Warner was contacted by some of the petitioners for this RID, who
complained that nothing had been done with the petition since it was filed four years ago.
Engineering responded that it needs an appraisal done on the properties involved, to
ensure that'the cost of improvements would not exceed the value of the properties involved,
in the event the County should need to foreclose in order to recover costs. Following
discussion at the 12/21/89 Public Services meeting, Engineering said it would stand firm
on this requirement. At the petitioner's request, the - hearing is being scheduled
whi:le.the'appraisal'is being sought.
RECOMMENDED ACTION.•
Recommend that Council set a hearing on the formation of the Academy Road RID
for February,,2 1990.

IN THE MATTER OF FORMATION OF WHATCOM COUNTY
ROAD IMPROVEMENT DISTRICT NO. 12 FOR IMPROVE-
MENT OF ACADEMY ROAD, TO COUNTY STANDARDS.
BE IT RESOLVED by the Whatcom County Council:

Whatcom County has been presented with, a petition to initiate formation of
a County Road Improvement District for improvement of Academy, in Sections 23 &
24, Township 38 North, Range 3 East of W.M. to Whatcom County standards.

The nature and territorial extent of the improvements shall be as follows:
1. Construction of Academy Road, beginning at the Minot Street Right -of-
way near end of existing pavement and extending east approximately
.72 miles, to Whatcom County standards.
SECTION 3.
The proposed Road Improvement District shall be designated as Whatcom
County Road Improvement District No. 12.

The legal description of the boundaries of the proposed Road Improvement
District is attached hereto as Exhibit "A ".

The total estimated cost of the improvements is $480,000

The entire cost and expense of the improvements will be borne by the pro-
perty within the proposed district. The proportionate cost per property will be
calculated on the basis of estimated cost per lot under current zoning
for maximum lots allowable.

Prior to passage of the ordinance establishing the RID, an appraisal will
need to be performed to determine that the special benefits derieved from the
improvements are greater than the assessment. Such appraisal to be paid by pro-
ponents, with the costs to be reimbursed by the RID after establishment.

3 Under RCW Chapter 35.72 and County Ordinance No. 84 -114, the Whatcom County
4 Council may allow for partial reimbursement to the owner or owners who contri-
5 buted to the original cost of the road project, by other property owners of real
6 estate who will directly benefit by zoning changes, direct private access, or
7 other direct benefit from the construction improvements.

9 SECTION 9.

11 The owners of property in said proposed Road Improvement District No. 12
12 shall be notified to appear at a meeting of the Whatcom County Council in the
13 Council hearing room on the second floor of the Whatcom County Courthouse to be
14 held at 7 p.m., on the 1st day of February , 19 90 , on proposed
15 Road Improvement District No. 12.

17 SECTION 10.

19 The County Engineer is directed to submit to the Council at or prior
20 to the meeting specified in the preceding section, a diagram or print showing
21 thereon the lots, tracts and parcels of land and property which will be spe-
22 cially benefited, and the estimated amount of the cost and expense to be borne
23 by each lot, tract, or pracel therein, and also designating thereon all property
24 which is being purchased under contract from the County.

26 SECTION 11.

28 This Resolution of Intention shall be published in at least two (2) con -
29 secutive issues of a newspaper of general circulation in the county, with the
30 date of the first publication to be at least fifteen (15) days prior to the date
31 fixed by this resolution for hearing before the Whatcom County Council.

33 SECTION 12.

35 The County Engineer shall see that notice of adoption of this Resolution of
36 Intention is given to each owner or reputed owner of a lot, tract, or parcel of
37 land within the proposed district by mailing to the owner or reputed owner of
38 the property as shown on the tax rolls of the County Treasurer at the address
39 shown thereon at least fifteen (15) days before the date fixed for public
40 hearing. The notice shall refer to this resolution and the designated number of
41 the improvement district, and shall set forth the nature of the proposed impro-
42 vement, the total estimated amount of the cost and expense of such improvement
43 to be borne by the particular lot, tract or parcel, the date and place of the
44 hearing before Whatcom County Council, and shall contain the directions for
45 voting upon the formation of the proposed district.

47 SECTION 13.

49 The Clerk of the Council shall prepare and mail, together with the notice
50 above referred to, a ballot for each owner or reputed owner of any lot, tract,
51 or parcel of land within the proposed improvement district. The ballot shall
52 contain the following proposition:

In section 7, we added a notation that the costs of the appraisal
would be collected in advance. The County may have some logistical
problems with collecting the appraisal costs in advance, before the
formation of the RID. You may wish to reconsider this issue as a
policy matter.

I checked on the Public Works meetings and found that the
group has become inactive. Coo strong is still working at
Snohomish County but has changed departments. if the group
