Yes/ No/ SUMMARY STATEMENT: A spokesperson for the Water District said the Board of Commissioners decided to seek the name change after citizens expressed confusion over the ballot title in the last election of Commissioners. The,Board decided it would make better sense to have "Glacier Water District" on the ballot rather than "Water District No. 14." Under RCW 57.04.065, action by the Water District Board of Commissioners to change the District's name must be approved by the county legislative authority. RECOMMENDED ACTION: Recommend approval of the resolution, COMMITTEE ACTION (including dates): 1 -4 -90: Public Services recommended a "do pass." Atty. • • • • . ;, ULI E 0 E � WE 0 DEC 15 1989 WHATCOM COUNTY COUNCIL RESOLUTION NO. 122 A RESOLUTION OF THE BOARD OF COMMISSIONERS OF GLACIER WATER DISTRICT NO. 14 CHANGING THE NAME OF GLACIER WATER DISTRICT NO. 14 TO GLACIER WATER DISTRICT WHEREAS, Glacier Water District No. 14 serves the Glacier area; and WHEREAS, there has in the past been a great deal of confusion over what the name of the water district is which serves the Glacier area; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF GLACIER WATER DISTRICT NO. 14, as follows: Section 1: The District No. 14 the approval of change the name the reason that closely reflect service area of Board of Commissioners of Glacier Water hereby declare their intention, subject to the Whatcom County Council and Executive, to of the district to Glacier Water District for the name Glacier Water District will more the service offered by the district and the the district. S CO I S,S- 10-NER / COMMISSIONER rRMI4.9IONER THIS IS TO CERTIFY that the above is a true and correct copy of Resolution No. 122 of the Board of Commissioners of Glacier Water District No. 14, Whatcom County, Washington, adopted at a regular meeting thereof on the 11th day of December, 1989. * ECRETARY 1 SECTION 8. 2 3 Under RCW Chapter 35.72, RCW 36.88.078 and County Ordinance No. 84 -114, the 4 Whatcom County Council may allow for partial reimbursement to the owner or owners 5 who contributed to the original cost of the road project, by other property 6 owner of real estate who will directly benefit by zoning changes, direct private 7 access or other direct benefit from the construction improvements. 8 9 SECTION 9. 10 11 The owners of property in said proposed Road Improvement District No. 12 12 shall be notified to appear at a meeting of the Whatcom County Council in the 13 Council hearing room on the second floor of the Whatcom County Courthouse to be 14 held at 7:00 p.m., on the 1st day of February 19 90 , on proposed 15 Road Improvement District No. 12. 16 17 SECTION 10. 18 19 The County Engineer is directed to submit to the Council at or prior 20 to the meeting specified in the preceding section, a diagram or print showing 21 thereon the lots, tracts and parcels of land and property which will be spe- 22 cially benefited, and the estimated amount of the cost and expense to be borne 23 by each lot, tract, or pracel therein, and also designating thereon all property 24 which is being purchased under contract from the County. 25 26 SECTION 11. 27 28 This Resolution of Intention shall be published in at least two (2) con - 29 secutive issues of a newspaper of general circulation in the county, with the 30 date of the first publication to be at least fifteen (15) days prior to the date 31 fixed by this resolution for hearing before the Whatcom County Council. 32 33 SECTION 12. 34 35 The County Engineer shall see that notice of adoption of this Resolution of 36 Intention is given to each owner or reputed owner of a lot, tract, or parcel of 37 land within the proposed district by mailing to the owner or reputed owner of 38 the property as shown on the tax rolls of the County Treasurer at the address 39 shown thereon at least fifteen (15) days before the date fixed for public 40 hearing. The notice shall refer to this resolution and the designated number of 41 the improvement district, and shall set forth the nature of the proposed impro- 42 vement, the total estimated amount of the cost and expense of such improvement 43 to be borne by the particular lot, tract or parcel, the date and place of the 44 hearing before Whatcom County Council, and shall contain the directions for 45 voting upon the formation of the proposed district. 46 47 SECTION 13. 48 49 The Clerk of the Council shall prepare and mail, together with the notice 50 above referred to, a ballot for each owner or reputed owner of any lot, tract, 51 or parcel of land within the proposed improvement district.
