SUMMARY STATEMENT.•
This concerns a small "island" of property within the Lynden City Limits that now belongs to the
County. The City is asking that the County consent to allowing the City to adjust its boundaries to include
this property. Apparently for years this property has been considered a part of Lynden, even by the
County Assessor. However, the Whatcom County Cartographer recently determined that there was a
mistake in the legal description of the annexation in 1957. The City would like the Council to approve
of this adjustment rather than going through the Boundary Review Board because of the time involved
with BRB proceedings.

Chief Civil Deputy Prosecutor Randy Watts reviewed the request and recommends passage of the
resolution.

1 RESOLUTION NO. 91_088
2 AGREEING WITH A RESOLUTION BY THE CTTY OF LYNDEN AND APPROVING
3 OF A BOUNDARY ADJUSTMENT, PURSUANT TO RCW 35A.13.330 AND .340
4 WHEREAS, the Whatcom County Council received a request from the City of
5 Lynden to adjust the boundary of the City of Lynden to include the following property
6 within the City limits:
7 "That portion of the Northwest quarter of the Northwest quarter lying
8 Northerly of the Railroad tracks all in Section 21, Township 40 North, Range
9 3 East of W.M., not currently within the Lynden City limits. Situate in
10 Whatcom County, Washington."
11 WHEREAS, the Council's legal representative has reviewed the request and finds
12 that the property is partly within the City and partly within the County; and .
13 WHEREAS, RCW 35A.13.330 and .340 allows for the incorporation of land by a city
14 without Boundary Review Board proceedings, with the consent of the County Legislative
15 authority;
16 NOW, THEREFORE, BE IT RESOLVED by the Whatcom County Council that the
17 appropriate boundaries be moved in order for the City of Lynden to annex the property
18 described within this resolution.
