R E S 91 -04 SPONSORED BY: Consent PROPOSED BY: County Executive INTRODUCTION DATE: 6/25/91 1 RESOLUTION NO. 91 -041 2 Showing Support for a Resolution of 3 Intent for the Formation 4 of a Lake Management District 5 for the Lake Samish Area 6 WHEREAS, Lake Samish is the main source of water for over 400 homes, and, 7 WHEREAS, the availability of water from Lake Samish has been a concern for 8 several years, one aspect of which is the low flow in Friday Creek during late 9 summer, thus affecting fish habitat, and a second aspect is that numerous users 10 do not have water rights from D.O.E., and, 11 WHEREAS, the Department of Ecology has issued a policy decision requiring 12 property owners to develop an acceptable plan to augment stream flow from .3 the Lake into Friday Creek during the late summer, dry season, and, 14 WHEREAS, until D.O.E. is satisfied "substantial progress" is being made on a 15 solution to this problem, new water rights permits will not be issued and 16 D.O.E. will "take action" on those currently illegally using lake water, and, 17 WHEREAS, following a public meeting held on May 15 for residents of the Lake 18 Samish area and tabulation of a survey conducted by the Lake Samish 19 Watershed Planning Committee a substantial number of residents indicated 20 their support of the formation of a Lake Management District for the purpose 21 of raising the funds to provide for stream flow augmentation of Friday Creek, 22 and, 23 WHEREAS, a Lake Management District may be initiated by the adoption of a 24 resolution by the County legislative authority, setting forth a number 25 of elements pertaining to the District, and, 26 WHEREAS, the Lake Samish Watershed Planning Committee and the County 27 administration are preparing the detailed information necessary for such a 28 resolution, but it is not yet complete and the D.O.E. needs some indication 29 that "substantial progress" is being made toward a solution to forestall its 30 taking legal action against current users who have no water rights, Page 1 1 NOW, THEREFORE, BE IT RESOLVED that the Whatcom County Council 2 declares it is supportive of passing a resolution of intent for the formation of 3 a Lake Management District for the Lake Samish area upon the presentation 4 of such resolution with all required findings and information as laid out in 5 R.C.W. 36.61.030.
