Yes l No / x/ SUMMARY STATEMENT.• The proposed resolution establishes a policy and procedures for handling private requests for groundwater and surface water sampling at County facilities. The County Council requested the Administration to draft such a policy earlier in the year. RECOMMENDED ACTION.- Pass. WHEREAS, Whatcom County has previously been requested by individuals to supply groundwater and surface water samples at its facilities for independent testing and information; WHEREAS, any benefit from groundwater and surface water monitoring is dependent on sampling methodology and test data comparability; and WHEREAS, no policy or procedure for responding to such requests presently exists; NOW, THEREFORE, BE IT RESOLVED that the following policy and procedures will be in effect to handle private requests made of Whatcom County to supply groundwater and /or surface water samples at County facilities for independent testing purposes: 1. POLICY - All requests from private firms or individuals for groundwater and /or surface water samples at County facilities should be in writing and be submitted to the County Executive. Such requests should include a statement of the need and purpose for having a private sample and review. 2. PROCEDURE - Upon receipt of a private request, the County Executive will direct it to the appropriate Department or Division Head as well as the County Health Officer for processing. The Department of Division Head and Health Officer will review the request to ensure that, at a minimum, the following requirements are included: a. The groundwater and /or surface water sampling and testing project shall be performed by a professional consultant having relevant expertise in the field of groundwater and surface water monitoring. b. A sampling and quality assurance plan shall be developed for approval by the Health Officer in advance of the sampling work. The affected departments shall review and comment on the plan within thirty (30) days of receipt. The sampling will be coordinated to coincide with the County's quarterly monitoring schedule. The monitoring is conducted in the months of March, June, September, and December. d. The test results and report document will be reviewed by the Department or Division Head and Health Officer before being publicly released. e. Any costs incurred by the County in the execution of the project will be charged to the requesting private party. These costs will be estimated and paid for before the project begins. 3. EXCEPTION — Requests for exception to all or any part of the above procedure may be made to the County Executive who, for purposes of unusual private circumstances or clear public benefit, could authorize an exception.
