8 WHEREAS, RCW 84.64.270 allows the County to sell real estate
9 acquired by tax foreclosures where it is found to be in the best
10 interest of Whatcom county to sell the same; and,
11 WHEREAS, Whatcom County Council does deem it to be in the
12 County's best interest to sell five Emerald Lake lots as one group (see
13 attached list), which have been received through tax foreclosure; and,
14 WHEREAS, the Whatcom County Engineering, Public Works, Parks,
15 Planning and Assessor Departments were contacted and expressed no
16 interest in retaining these properties for County use; and
17 WHEREAS, the Whatcom County Code as well as the state law
18 allows the County to reserve from the sale, coal, oil, gas, gravel,
19 mineral, ores, fossils, timber or other resources if the Council finds
20 that it is in the best interest to reserve these; and,
21 WHEREAS, the Whatcom County Council has determined that it is
2 in the best interest of the County to sell said lot(s) subject to a
23 restrictive covenant allowing for imposition of community Association
24 fees; and,
25 WHEREAS, RCW 84.64 requires the Council to establish the
26 minimum price for said unit of property and to determine whether or not
27 a contract will be allowed or if it will be a cash price; and,
28 WHEREAS, the Whatcom County Council deems that the price of
29 $10,897.84 is the minimum price for said lot(s) and that it is low
30 enough not to accept a contract on this price but would be in the
31 County's best interest and the Council would require that this amount be
32 paid in cash;
33 NOW, THEREFORE, BE IT RESOLVED that it is in the best interest
34 of the County to sell five Emerald Lake lots as one group (see attached
35 list) for the minimum price of $10,897.84 plus costs and further in this
36 sale transferring to the owners all coal, oil, gas, gravel, minerals,
37 ores, fossils, timber or other resources on or in- said lands and the
38 right to mine for and remove the same in conformity with zoning
39 regulations in force and effect;
40 BE IT FURTHER RESOLVED that said lot(s) shall be sold subject
41 to the restrictive covenant allowing for imposition of Community
42 Association fees as set forth in Whatcom County Resolution No. 88 -37;

I BE IT FURTHER RESOLVED that this sale shall be subject to the
2 certification of the County Treasurer. Once the Treasurer shall certify
3 that the price set in the Resolution is the actual amount of taxes which
4 are owed to the County as provided for in RCW 86.64.270, she shall
5 direct the sale to take place;
6 BE IT FURTHER RESOLVED that said price shall not be allowed
7 under contract and shall be paid in either cash, certified check, or
8 money order to the Whatcom County Treasurer at the time of sale;
9 BE IT FURTHER RESOLVED that the Whatcom County Treasurer is
10 hereby directed to sell such property at not less than a certified price
11 and said sale shall take place in accordance with the duties as
12 established in RCW 84.64.270.
