SUMMARY STATEMENT.•
Naiver of bid requirements necessary to allow leasing of office space for temporary
relocation of various County offices due to construction of addition and remodification of
existing County Courthouse.

RESOLUTION REQUESTING A WAIVER OF BID REQUIREMENTS FOR
LEASING OF OFFICE SPACE AND AUTHORIZING THE COUNTY EXECUTIVE
TO NEGOTIATE AGREEMENT FOR SAME IN ACCORDANCE WITH
WHATCOM COUNTY CODE 3.0$.180 -B
WHEREAS, the Whatcom County Code, Section 3.08.180 -8 provides that when the County Council upon
recommendation of the County Executive finds that a waiver of bid requirements will be in the best interest
of Whatcom County, the County Council may waive bid requirements and allow the County Executive to negotiate
contracts for leases, and
WHEREAS, the Home Rule Charter for Whatcom County, Section 6.90 provides that the County may lease
private real property for more than one year if it is included in the Capital Budget Appropriation Ordinance,
and
WHEREAS, the County Executive has recommended and the County Council has approved the Capital Budget
Appropriation providing for funds for leasing of office space in the 1991 budget, Ordinance No. 90 -110 and
Resolution No. 90-75, adopting the 1991 Six -Year Physical Plant and Facilities Capital Program, and
WHEREAS, the County Executive has determined it is necessary that various offices must be temporarily
relocated due to construction of the addition and remodification to the existing Courthouse, and
WHEREAS, the County Executive has determined that it is in the best interest of Whatcom County to waive
the bid requirements for leasing of real property for county office space,
NOW, THEREFORE, BE IT RESOLVED that the County Council has determined that the County Executive's
recommendation for a waiver is in the best interest of Whatcom County; waives the bid requirements for the
Leasing of office space and authorizes the County Executive to negotiate and enter into an agreement for same
not to exceed a period of two years, with a two -year option at no more than $9.75 per square foot plus triple
net, with facilities comparable to the DIS proposal of March 18, 1991.
