Ordinance or Resolution Number: RFS9i -oi 4 ssb5M.ms 3/19/91 SPONSORED BY: Haney PROPOSED BY: Haney INTRODUCTION DATE: 3126191 1 RESOLUTION NO. 91-014 2 SUPPORTING SUBSTITUTE SENATE BILL 5097, A FARMER'S 3 RIGHT -TO -FARM ACT CLARIFICATION 4 WHEREAS, in 1979 the State adopted a "right -to- farm" statute to acknowledge the 5 right to perform certain agricultural practices in urbanizing areas; and 6 WHEREAS, the definition of "agriculture activity" was not clear in all cases; and 7 WHEREAS, agriculture is the largest commercial activity in this State and is 8 extremely important to the economy and well being of the citizens of this State, and 9 WHEREAS, passage of substitute Senate Bill 5097, legislation which has bi- partisan 10 support, would clarify that agriculture activities complying with federal, State, and local laws 11 is presumed to be a good agricultural practice and not adversely affecting the public health 12 and safety; and 13 WHEREAS, such clarification is aimed at reducing the possibility of nuisance suits 14 being filed against farmers of long standing whose land is being surrounded by urbanized 15 growth; 16 NOW, THEREFORE, BE IT RESOLVED that the Whatcom County Council 17 supports SSB 5097 and urges its passage by the State Legislature and signature by the 18 Governor; and SSB5097.res, Page 1 1 BE IT FURTHER RESOLVED that copies of this resolution be forwarded to the 2 Legislative delegation from the 40th and 42nd Districts, and to the Governor. 3 APPROVED this 26TH day of MARCH , 1991. 4 5 ATTEST: 6 7 Ramona Reeves, Council Clerk 9 10 APPROVED AS TO FORM: Civil Deputy Pros.
