SUMMARY STATEMENT.•
An Agreement cannot be reached with several of the property owners along South Pass
Road (Highway 9 to Goodwin Road) to purchase an additional 10 -foot strip of right -of-
way for the South Pass Road reconstruction project scheduled for the summer of 1991.
ORIGINATOR'S RECOMMENDED ACTION.
To authorize the County Prosecuting Attorney's office to proceed with legal action
to acquire said right -of -way by condemnation.

RESOLUTION NO. 91 -013
A RESOLUTION AUTHORIZING THE COUNTY PROSECUTING ATTORNEY'S
OFFICE TO PROCEED WITH LEGAL ACTION TO ACQUIRE FRONTAGE FROM
SEVERAL PARCELS OF LAND ALONG SOUTH PASS ROAD FOR RIGHT -OF -WAY
PURPOSES, BY CONDEMNATION
WHEREAS, Whatcom County adopted the reconstruction of South
Pass Road, Nooksack City limits to Goodwin Road, as item #7 of
the 1991 Annual Construction Program on November 20, 1990, as
Ordinance 90 -76, and
WHEREAS, Whatcom County has received funds from the State
County Road Administration Board for said reconstruction project,
and
WHEREAS, Whatcom County needs to obtain additional right -of-
way along said project limits to accommodate relocated utilities,
and
WHEREAS, an agreement cannot be reached with several of the
involved property owners to purchase said right -of -way.
NOW, BE IT RESOLVED, that the County Council does hereby
authorize the County Prosecuting Attorney's office to proceed with
legal action to acquire said parcels of land, for the purpose
stated herein by condemnation.
