Yes /_/Nol3aj SUMMARY STATEMENT• Fire District No. 14, located in the Sumas- Kendall- Deming area, wishes to annex a portion of Mosquito Lake Road. Sixty percent of the qualified registered voters within the proposed addition signed a petition` requesting the annexation. Under state law, when that many voters within an area proposed to be annexed by a Fire District favor the proposal, an election and hearing on the proposal can be dispensed with. Under these circumstances, the Council is required to pass a resolution ordering that the territory be incorporated into the existing Fire Protection District. ORIGINATOR'S RECOMMENDED ACTION.• Auditor recommends that the Council enter such an order. RE.S 91- 0 0 9 firedist.res 2/20/91 SPONSORED BY: Consent PROPOSED BY: Fire Dist. 14 INTRODUCTION DATE: 2/26 /91 RESOLUTION NO. gl-.,QQ9 2 ORDERING THE INCORPORATION OF CERTAIN TERRITORY 3 INTO FIRE PROTECTION DISTRICT NO. 14 4 WHEREAS, a petition was circulated requesting that an area along Mosquito Lake 5 Road be annexed by Fire District No. 14, which serves Sumas, Kendall and the Deming 6 areas; and 7 WHEREAS, the Fire Commissioners of the district concur with the petition; and 8 WHEREAS, the Auditor has certified that 60 percent of the qualified registered 9 voters within the area proposed to be annexed signed the petition; and 10 WHEREAS, under these circumstances and by the authority of RCW 52.04.011 (3), 11 the hearing on this petition shall be dispensed with and the County Council shall enter an ? order incorporating the territory into the existing fire protection district; 13 NOW, THEREFORE, BE IT RESOLVED by the Whatcom County Council that it 14 hereby orders the incorporation of the following territory into Whatcom County Fire 15 Protection District No. 14: 16 The Mosquito Lake Road area to be annexed includes the following property 17 situated in Whatcom County and not located in any other fire district or 18 municipal corporation: Commencing at the corner between sections 25, 26, 19 35, and 36 of Township 39 N, Rage 5E (W.M.) hence westerly along the north 20 section line of sections 34 and 35 to the east meander line of the Middle Fork 21 of the Nooksack River hence southeasterly along said line to the east -west 22 centerline of section 13 of Township 38N, Range 5E (W.M.) hence easterly 23 to the center of section 13 hence northerly on centerlines of sections 12 and 24 13 to the north quarter corner of section 12 hence westerly to the section 25 comer between sections 1, 2, 11, and 12 of Township 38N, Range 5E (W.M.) 26 hence north between sections 1 and 2 to Township 39N, Range 5E (W.M.) to 27 the southeast corner of section 35 hence north to the northeast corner of 28 section 35 and the point of origin.
