Recommend approval COMMITTEE ACTION (including dates): COUNCIL ACTION (including dates): 1- 22 -91: Council passed 7 -0 Related File Numbers: Ordinance or Resolution Number: RES91 -006 INTRODUCED BY Consent 8 Sol DATE 1/22/ 91 RESOLUTION NO. 91 -006 A RESOLUTION OF THE COUNTY COUNCIL OF WHATCOM COUNTY, WASHINGTON, PROPOSING THE CREATION OF A DIKING DISTRICT FOR THE PURPOSE OF UNDERTAKING AND MAINTAINING CERTAIN. FLOOD CONTROL IMPROVEMENT PROJECTS: SETTING FORTH THE BOUNDARIES OF SAID DIKING DISTRICT; AND DIRECTING THE COUNTY ENGINEER TO INVESTIGATE THE PROPOSED BOUNDARIES OF SAID DIKING DISTRICT AND THE FEASIBILITY OF SAID PROJECTS. WHERAS, Whatcom County has received a request from a number of property owners to create a Diking District in the Deming area; and WHERAS, per RCW 85.38.020, the County Council may by resolution propose the creation of said Diking District; and WHERAS, the objects sought by the creation of said district, along with the projects proposed to be completed by said district to accomplish these objects, are included in this resolution as attached Exhibit A; and WHERAS, the boundaries of said proposed Diking District are included in this resolution as attached Exhibit B; and WHERAS, pursuant to RCW 85.38.030, the Council shall direct the County Engineer to investigate the proposed boundaries of said Diking District; and WHERAS, it is desireable that the public hearing regarding said proposed district, per RCW 85.38.040, be held expeditiously to be included on the May 15, 1991 special elections ballot; NOW, THEREFORE, BE IT RESOLVED, that the County Council does hereby propose the creation of a diking district for the purpose of undertaking and maintaining certain flood control improvement projects, and does further direct the County Engineer to investigate the proposed boundaries of said Diking District and the feasibility of said projects per the attached exhibits, and to report regarding the creation of said Diking District at a public hearing hereby scheduled for March 12, 1991. Warner Chairperson EXHIBIT 'A' PROPOSED DEMING DIKING DISTRICT OBJECTS SOUGHT AND PROJECTS PROPOSED Objects sought by the creation of the Deming Diking District: A. To keep the Nooksack River inside its banks at all times, within the district boundaries. B. To keep the river channel wide open and prevent the accumulation of gravel and debris within the district boundaries. C. To prevent erosion along the river bank within the district boundaries. Projects proposed to be completed by the Deming Diking District that will accomplish the above objects: A. Construct dikes in vulnerable areas and enlarge them in the future. B. Protect the river bank with riprap. C. Deepen and widen the river channel. D. Remove large gravel bars and log jams. E. Develop and implement an on -going maintenance program for the river channel and the district projects. EXHIBIT 'B' LEGAL DESCRIPTION PROPOSED DEMING DIKING DISTRICT A diking district contained within and being portions of Section 31, Township 39 North, Range 5 East of W.M. and Sections 21,22,25,26,27,28,35 and 36, Township 39 North, Range 4 East of W.M., Whatcom County, Washington and being further described as folllows; Beginning at the South one quarter corner of said Section 31; thence northerly along the north -south center of section line, 1060 feet, more or less, to the Southerly Right of Way line of the Northern Pacific Railroad Right of Way; thence Northwesterly along said Southerly Right of Way line, 4.6 miles, more or less, to the North line of the Southwest quarter of the Northeast quarter of Section 21, Township 39 North, Range 4 East of W.M.; thence Westerly along said North line to the Northwest corner of the Southwest quarter of the Northeast quarter of said section 21; thence Southerly along the north -south center of section line to the Quarter Corner common to sections 21 and 28, Township 39 North, Range 4 East of W.M.; thence Easterly along the section line common to said sections, to the Northeast corner of the Northwest quarter of the Northeast quarter of said section 28; thence Southerly along the East line of said quarter quarter extended to intersect the Northerly or Right bank, Ordinary High Water Line of the Nooksack River; thence Southeasterly along said Ordinary High Water line to the South line of Section 36, Township 39 North, Range 4 East of W.M.; thence Easterly along the South line of said Section 36 and the South line of Section 31, Township 39 North, Range 5 East of W.M. to the South One Quarter Corner of said Section 31 and the Point of Beginning.
