This had previously been referred to the County Executive who was unable to certify a governmental need
because the County has its own fuel facilities /accounts. However, after discussion with the state Pollution
ability Insurance Agency, the owner, Mr. Al Dobrenz, has brought forward letters from Fire District # 9 and
Water District #12 establishing a public need for service on the part of those agencies. Passage of the attached
resolution by the Council is required by the state for Mr. Dobrenz to be able to qualify for the grant.

2 ENDORSEMENT OF GRANT APPLICATION FOR
3 AL & CARMIN'S MARKET
4 WHEREAS, the Whatcom County Council has reviewed information supplied by Al
5 & Carmin's Market in application for a grant relating to upgrading of fuel storage tanks;
6 and
7 WHEREAS, the Council finds that Alfred J Dobrenz certifies that he is the owner
8 and operator of Al & Carm&s Market; and
9 WHEREAS, the County Council finds that other retail petroleum product retailers
10 are located remote from the community around Lake Samish; and
11 WHEREAS, Whatcom County Fire Protection District # 9 has indicated that Al &
12 Carmin's Market is their lone local source of supply for fuel; and
13 WHEREAS, Winton Wefer, Commissioner of Whatcom County Fire Protection
14 District #9 has been designated by the fire protection district as the person responsible for
15 negotiating a cost -plus basis agreement with the applicant, if successful in receiving grant
16 assistance, so that the fire district .can purchase petroleum products under that agreement;
17 and
18 WHEREAS, Whatcom County Water District No. 12 has indicated that they also will
19 utilize Al & Carmin's Market as a fuel source and have authorized Don Weiland, Manager
20 of Water District #12 to negotiate a cost -plus contract; and
21 WHEREAS, the twelve years that the existing ownership has operated the station
22 provides evidence that the applicant is capable of fulfilling the agreement required by the
23 state of Washington for providing financial assistance; and
24 WHEREAS, the County Council finds that the applicant, by selling petroleum
25 products in the Lake Samish area to the fire protection district, meets a vital public safety
26 need;

1 NOW, THEREFORE, BE IT RESOLVED by the Whatcom County Council that
2 certification is hereby provided to the state of Washington that Al & Carmin's Market
3 should be considered for financial assistance to be used for corrective action and repair,
4 replacement, reconstruction, and improvement of its underground petroleum storage tank(s)
5 and tank site. The completion of the attached certification form is a good faith effort on the
6 part of Whatcom County to certify that the continued operation of Al & Carmin's Market
7 petroleum underground storage tanks meets a vital local, public health or safety need. This
8 certification form does not represent comprehensive research of all applicable laws and
9 regulations. Al & Carmin's Market remains responsible for fulfilling all laws, ordinances and
10 regulations in effect at the time that work commences at the underground storage tank site.
