Resolution authorizing the sale of property acquired by county on tax foreclosure. Request

SUMMARY STATEMENT:
This resolution involves property described as follows:
Parcel #400131- 031326 -0234, Cabana Club Condominium Unit: 203 -Undiv 1/48 Int in TSU L -24.
ORIGINATOR'S RECOMMENDED ACTION:
Folloving the hearing, the Treasurer recommends that the resolution be passed.

5 TO SELL PROPERTY ACQUIRED BY COUNTY
6 ON TAX FORECLOSURE

8 WHEREAS, RCW 84.64.270 allows the County to sell real estate
9 acquired by tax foreclosures where it is found to be in the best
10 interest of Whatcom County to sell the same; and,
11 WHEREAS, Whatcom County Council does deem it to be in the
12 County's best interest to sell parcel #400131 - 031326 -0234; which has
13 been received through tax foreclosure; and,
14 WHEREAS, the Whatcom County Property Management Committee has
15 recommended the sale of the subject property at no less than $500.00;
16 WHEREAS, the Whatcom County Code as well as the state law
17 allows the County to reserve from the sale, coal, oil, gas, gravel,
18 mineral, ores, fossils, timber or other resources if the Council finds
19 that it is in the best interest to reserve these; and,
20 WHEREAS, the Whatcom County Council has determined that it is
21 in the best interest of the County to sell said lot(s) subject to a
Z restrictive covenant allowing for imposition of community association
23 fees; and,
24 WHEREAS, RCW 84.64 requires the Council to establish the
25 minimum price for said unit of property and to determine whether or not
26 a contract will be allowed or if it will be a cash price; and,
27 WHEREAS, the minimum price of $500.00 is low enough not to
28 accept a contract on this price but would be in the County's best
29 interest and the Council would require that this .amount be paid in cash;
30 NOW, THEREFORE, BE IT RESOLVED that it is in the best interest
31 of the County to sell parcel #400131- 031326 -0234 for the recommended
32 minimum price of $500.00, plus costs and further in this sale
33 transferring to the owners all coal, oil, gas, gravel, minerals, ores,
34 fossils, timber or other resources on or in said land and the right to
35 mine for and remove the same in conformity with zoning regulations in-
36 force and effect;
37 BE IT FURTHER RESOLVED that said lot(s) shall be sold subject
38 to the restrictive covenant allowing for imposition of community
39 association fees as set forth in Whatcom County Resolution No. 88 -37;

I BE -IT FURTHER RESOLVED that this sale shall be subject to the
certification of the County Treasurer. Once the Treasurer shall certify
that the price set in the Resolution is at least the amount of taxes
4 which are owed to the County as provided for in RCW 86.64. 270, she shall.
5 direct the sale to take place;
6 BE IT FURTHER RESOLVED that said price shall not be allowed
7 under contract and shall be paid in either cash, certified check, or
8 money order to the Whatcom County Treasurer at the time of sale;
9 BE IT FURTHER RESOLVED that the Whatcom County Treasurer is
10 hereby directed to sell such property at not less than a certified price
11 and said sale shall take place in accordance with the duties as
12 established in RCW 84.64.270.
