5 TO SELL PROPERTY ACQUIRED BY COUNTY
6 ON TAX FORECLOSURE
7 REQUEST NO. 71
8 WHEREAS, RCW 84.64.270 allows the County to sell real estate
9 acquired by tax foreclosures where it is found to be in the best
10 interest of Whatcom county to sell the same; and,
11 WHEREAS, Whatcom County Council does deem it to be in the
12 County's best interest to sell parcel #380335- 075340; which has been
13 received through tax foreclosure; and,
14 WHEREAS, the Whatcom County Code as well as the state law
15 allows the County to reserve from the sale, coal, oil, gas, gravel,
16 mineral, ores, fossils, timber or other resources if the Council finds
17 that it is in the best interest to reserve these; and,
18 WHEREAS, the Whatcom County Council has determined that it is
19 in the best interest of the County to sell said lot(s) subject to a
20 restrictive covenant allowing for imposition of community association
21 fees; and,
2_ WHEREAS, the Whatcom County Council has determined that the
23 property should be sold subject to the remaining assessment balance for
24 RID -5 and Water District 10; and,
25 WHEREAS, RCW 84.64 requires the Council to establish the
26 minimum price for said unit of property and to determine whether or not
27 a contract will be allowed or if.it will be a cash price; and,
28 WHEREAS, the minimum price of said property is $13,538.96 and
29 that it is low enough not to accept a contract on this price but would
30 be in the County's best interest and the Council would require that this
31 amount be paid in cash;
32 NOW, THEREFORE, BE IT RESOLVED that it is in the best interest
33 of the County to sell parcel #380335 - 075340 for the recommended minimum
34 price of $13, 538. 96, plus costs and further in this sale transferring to
35 the owners all coal, oil, gas, gravel, minerals, ores, fossils, timber
36 or other resources on or in said land and the right to mine for and
37 remove the same in conformity with zoning regulations in force and
38 effect;
39 BE IT FURTHER RESOLVED that said lot(s) shall be sold subject
40 to the restrictive covenant allowing for imposition of community
41 association fees as set forth in Whatcom County Resolution No. 88 -37;

1 BE IT FURTHER RESOLVED that this sale shall be subject to the
certification of the County Treasurer. Once the Treasurer shall certify
3 that the price set in the Resolution is at least the amount of taxes
4 which are owed to the County--as provided for in RCW 86.64. 270, she shall
5 direct the sale to take place;
6 HE IT FURTHER RESOLVED that said price shall not be allowed
7 under contract and shall be paid in either cash, certified check, or
8 money order to the Whatcom County Treasurer at the time of sale;
9 HE IT FURTHER RESOLVED that the Whatcom County Treasurer is
10 hereby directed to sell such property at not less than a certified price
11 and said sale shall take place in accordance with the duties as
12 established in RCW 84.64. -270.
