ATTACHMENTS: Resolution SUMMARY STATEMENT- LMD) t. Di Public Hearing Needed? Yes /� lNo/x / Members of the Whatcom County Council compose the governing body of Lake Management District No. 1. The District is a governmental entity separate from Whatcom County; actions of the governing body must be separate from actions of the County Council. One noticeable difference between the two separate entities is the method used to enact laws or regulations: While County laws are enacted by ordinance, District laws are enacted by resolution. This resolution of the governing body sets forth the operating rules for the governing body in an attempt to clarify how actions will be publicized, what form they will be in, where the information will be filed, etc. An attempt was made to coordinate the procedures for the Council and the governing body, to avoid creating two separate systems for the staff to bear in mind. ORIGINATOR'S RECOMMENDED ACTION.• The Council should convene a meeting of the Lake Management District No. 1 governing body and adopt the attached resolution. COMMITTEE ACTION (including dates): COUNCIL ACTION (including dates): 2/25/92: Council approved resolution. 7-0 Related File Numbers: Ordinance or Resolution Number., R92 -022 SPONSORED BY: Consent PROPOSED BY: Executive INTRODUCTION DATE: 2/11/92 1 A Resolution by the Board of Supervisors for the 2 bake Mmiagement Dbirid No. I 3 4 RESOLUTION NO. 92-022 5 LAKE MANAGEMENT DISTRICT NO. 1 BOARD OF SUPERVISORS BYLAWS 6 7 WHEREAS, the Whatcom County Council is the supervising board of the Lake 8 Management District No. 1, as provided for in RCW 36.61; and 9 10 WHEREAS, it is convenient for the rules of procedure governing the Whatcom 11 County Council in the performance of its regular duties to apply to the governing board of 12 the Lake Management District No. 1 as well, to the extent possible; and 13 14 WHEREAS, the Council's attorney has determined it is necessary to separate the 15 actions of the Lake Management District No. 1 from the actions of the County Council; 16 17 NOW, THEREFORE, BE IT RESOLVED by the Whatcom County Lake 18 Management District No. 1 Board that the following will serve as bylaws for the Board: 19 20 1 Membership. Pursuant to RCW 36.61, Whatcom County Council members shall 21 be the Board of Supervisors of all lake management districts created within Whatcom 22 County. The Chairperson of the Whatcom County Council shall also serve as the 23 Chairperson of the Board of Supervisors (hereinafter referred to as the 'Board "). 24 25 2 Powers. Powers of the Board are as stipulated in RCW 36.61. Administration of 26 the Lake Management District No. 1 shall be in accordance with RCW 36.61. 27 28 3 Meetings. The Board will meet as often as there is business to conduct, and 29 whenever possible the meetings will take place on the same dates scheduled for County 30 Council meetings. Special meetings may be called by the chairperson as required, provided 31 proper public notice and notice to Board members is given. Meetings of the Board and its 32 advisory committee are subject to the - state's Open Public Meetings Act. 33 34 4 Meetings -- Sturgis Standard Code of Parliamentary Procedure. Board business 35 shall be conducted pursuant to "Sturgis Standard Code of Parliamentary Procedure," latest 36 edition, except when in conflict with the standing rules of the Board. 37 38 5 Quorum. Requirements for a quorum of the board shall be the same as those for 39 the County Council under Whatcom County Code 2.02.060. 40 41 6 Staff. The Clerk of the Council shall - provide primary staff support to the Board, 42 with other Council staff members assisting the Board as needed. The Board will be advised 43 by, and may assign tasks to, a Lake Management District No. 1 Advisory Committee in Page 1 I consultation with the County's Engineering Division. 2 3 7 Agenda and conduct of business. The agenda and conduct of business for the 4 Board shall comply with the procedures for the Council set forth in Whatcom County Code 5 2.02, Whatcom County Home Rule Charter Article 2, by Council policy resolutions and by 6 state law. 7 8 8 Resolutions of the Board. The introduction, publication, consideration and 9 adoption of resolutions of the Board which carry the force of law or which exercise the 10 powers of the Board shall be accomplished following the same procedure as that used for 11 ordinances of the Whatcom County Council, except where otherwise stipulated by state law. 12 13 9 Budget. The budget for the Lake Management District No. 1 shall be prepared 14 by the Whatcom County Engineering Division and reviewed by the Lake Management 15 District No. 1 Advisory Committee prior to submittal to the Executive and Council. The 16 presentation and review of the budget by the Executive and Council shall conform with the 17 budget requirements in the Whatcom County Home Rule Charter and Whatcom County 18 Code. 19 20 10 Documents -- form. Official documents issued by order of the Board should be 21 easily distinguished from documents issued by order of the County Council. A format for 22 resolutions of the Board shall be established by the Clerk of the Council. 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 47 11 Signature of documents. All official documents issued by order of the Board shall be signed by the Board Chairperson and attested by the Clerk of the Council. 12 Records. Actions of the Board and minutes of Board meetings shall be maintained in the same manner as are Council records, and if appropriate, may be filed, recorded and stored within existing systems in the Council Office. The Clerk will keep a separate index of actions taken by the Board. ADOPTED this 25th day of February1992.
