Yes / -IN61�1 SUMMARY STATEMENT. • Whatcom County Council Members serve as the Flood Control Zone District Board of Supervisors. The Board of Supervisors for the Zone function as a governmental entity separate from Whatcom County; actions of the Board must be separate from actions of the County Council. One noticeable difference between the two separate entities is the method used to enact laws or regulations: While County laws are enacted by ordinance, Zone laws are enacted by resolution. . This resolution of the Board sets forth the operating rules for the Board, in an attempt to clarify how actions will be publicized, what form they will be in, where the information will be filed, etc. Overall, an attempt was made to coordinate the procedures for the Council and the Board to avoid creating two separate systems for the staff to bear in mind. ORIGINATOR'S RECOMMENDED ACTION.• The Clerk of the Council recommends that the Council convene a meeting of the Flood Control Zone District Board of Supervisors and adopt the attached resolution. R92 -014 flmdby= 12 /23/91 SPONSORED BY: Warner PROPOSED BY: Council Clerk INTRODUCTION DATE: '117 .192 1 A Resobition by the Board of Supervisors for the 2 County Flood Control Zone District 3 4 RESOLUTION No. 92 -'0 14 5 FLOOD CONTROL ZONE DISTRICT BOARD OF SUPERVISORS BYLAWS 6 I 7 WHEREAS, the Whatcom Count' Council is the supervising board of the Flood 8 Control Zone District, as provided for in RCW 86.15:050; and 9 10 WHEREAS, it is convenient for the rules of procedure governing the Whatcom 11 County Council in the performance of its regular duties to apply to the governing board of 12 the Flood Control Zone District as well, to the extent possible; and 13 14 WHEREAS, the Council's attorney has determined it is necessary to separate the 15 actions of the Flood Control Zone District from the actions of the County Council; 16 17 NOW, THEREFORE, BE IT RESOLVED by the Whatcom County Flood Control 18 Zone District Board that the following will serve as bylaws for the Board: t9 20 1 Membership. Pursuant to RCW 86.15.050, Whatcom County Council members 21 shall be the Board of Supervisors of all flood control zone districts created within Whatcom. 22 County. The Chairperson of the Whatcom County' Council shall also -serve as the 23 Chairperson of the Board of Supervisors (hereinafter referred to as the "Board "). 24 25 2 Powers. Powers of the Board area as stipulated in RCW 86.15.080. Administration 26 of the Flood Control Zone District shall be in accordance with RCW 86.15.060. 27 28 3 Meetings. The Board will meet as often as there is business to conduct, and 29 whenever possible the meetings will take place on the same dates scheduled for County 30 Council meetings. Special meetings may be called by the chairperson as required, provided 31 proper public notice and notice to Board members is given. Meetings of the Board and its 32 advisory committee are subject to the state's Open Public Meetings Act. 33 34 4 Meetings -- Sturgis Standard Code of Parliamentary+ Procedure. Board business 35 shall be conducted pursuant to "Sturgis Standard Code of Parliamentary Procedure," latest 36 edition, except when in conflict with the standing rules of the Board. 37 38 5 Quorum. Requirements for a quorum of the board shall be the same as those for 39 the County Council under Whatcom County Code 2.02.060. 40 11 6 Staff. The Clerk of the Council shall provide primary staff support to the Board, 42 with other Council staff members assisting'the Board as needed. The agenda and conduct of business for the Board shall comply with the procedures foi the Council set forth in Whatcom County Code 2.02, Whatcom County Home Rule Charter Article 2, by Council policy resolutions and by state law. 8 Resolutions of the Board. The introduction, publication, consideration and adoption of resolutions of the Board which carry the force of law or which exercise the powers of the Board as listed in RCW 86.15.080 shall be accomplished following the same procedure as that used for ordinances of the Whatcom County Council, except where otherwise stipulated by state law. 9 Budget. The budget for the Flood Control Zone District shall be prepared by the Administrator of the County's Flood Control Section and reviewed by the Flood Control Advisory Committee prior to submittal to the Executive and Council. The presentation and review of the budget by the Executive and Council shall conform with the budget requirements in the Whatcom County Home Rule Charter and Whatcom County Code. 10 Documents -- form. Official documents issued by order of the Board should be easily distinguished from documents issued by order of the County Council. A format for resolutions of the Board shall be established by the Clerk of the Council. I 11 Signature of documents. All official documents issued by order of the Board shall be signed by the Board Chairperson and attested by the Clerk of the Council. 12 Records. Actions of the Board and minutes of Board meetings shall be maintained in the same manner as are Council records, and if appropriate, may be filed, recorded and stored within existing systems in the Council Office. The Clerk will keep a separate index of actions taken by the Board. ADOPTED this 28th day ofJanuary 1992.
