The purpose of this resolution is to withdraw from sale, two parcels that were actually roads, alleys or highways
. , which the County simply holds an interest which is in the nature of an easement and does not have a fee
interest. Whatcom County will retain them as an asset at this time.

2 AUTHORIZING THE WHATCOM COUNTY TREASURER
3 TO WITHDRAW FROM SALE CERTAIN PROPERTIES
4 DECLARED TO BE SURPLUS
5 WHEREAS, R.C.W. 84.64.270 and R.C.W. 36.34.010 allows the County to sell real
6 estate when it is found to be in the County's best interest, and;
7 WHEREAS, on March 2, 1993, a public hearing was held to determine if it was in the
8 County's best interest to sell certain properties, and;
9 WHEREAS, no testimony was received and the Whatcom County Council did
_J determine to sell certain properties and instructed the Whatcom County Treasurer to
11 proceed with the sale, and;
12 WHEREAS, the Whatcom County Treasurer notified certain property owners of the
13 pending sale, and;
14 WHEREAS, it has now come to the attention of the Whatcom County Treasurer and
15 the Whatcom County Council that two of these properties are county roads, alleys or
16 highways for which the county simply holds an interest which is in the nature of an easement
17 and does not have a fee interest, and;
18 WHEREAS, these properties are described as follows:

26 NOW, THEREFORE, BE IT RESOLVED, that the Whatcom County Council instructs the
27 Whatcom County Treasurer to withdraw these two parcels from the sale scheduled June 10,
28 1993, and retain them as an asset of Whatcom County at this time.
